    Without a question mark, I'll assume it's a fact, but based on what?
    You have certain rights where there is a dropped curb, this seems like a track leading to nowhere or other properties.
    He has stated its not his land, I assume its rough ground and no dropped curb. Any access rights would be for the owner of the land.
