    Aah that order doesn't define who can sign a WS. Never mind! You should argue that their WS should be given far less weight because the witness had no intention of attending the hearing and is a third party without actual knowledge of the car park or any facts.

    ANOTHER ONE BITES THE DUST!

    I had my hearing today and the claim was struck without me having to speak a word. The Judge found that the Claimant's WS did not sufficiently provide proof of who and how they were contracted to enforce parking in the area. I did ask for costs and that was the only time I spoke. All over in under 10 mins. Thank you for all the help.

    Did they send a rep who flailed pointlessly to try to justify the scam and polish the proverbial?

    They did not send a rep, which I think worked in my favour. The Judge was reviewing the Claimant's WS (aloud), and made a point that, given GS did not send a rep, he had no way of proceeding forward as his questions around contract between PCM and the landowners could not be answered. 

    Here is a breakdown of the hearing for anyone reading this and has an upcoming hearing.

    1. The court of hearing was changed last minute and this was informed via email.
    2. Arrived at the court half hour prior to the scheduled hearing.
    3. The court I was at had two judges hearing 8 small claims all scheduled for the same time 10 AM.
    4. After a lengthy wait, I was ushered in around midday.
    5. Upon exchanging greetings, the judge went on to ask who I was and explained the process - that he will first review Claimant's documents and will then give me chance to defend and put forward my case.
    6. He went through the claim form, and then, went about considering the Claimant's WS, making remarks. 
    7. One such remark was the absence of clear proof that the landowners had entered into a contract with the Claimant.
    8. He said he was striking the claim and that I could leave. 
    9. I requested the Judge to consider costs from my end before leaving the room.
