Received a Claim from the CNBC for a PCN I never received. Alleged offence was from May 2019!

    Neither, read it again, carefully

The Claimant is ordered to reply to the defence in writing by that deadline, by submitting their reply to that local civil court mentioned on the paperwork

Failure would mean that the claim is struck out, binned

Unusual, in that the CNBC issued DQs already which means that the claimant did reply to the defence. Did you apply to the court for this order? If the claimant hadn’t responded to the defence, the case would have been stayed. If the claimant wanted to un-stay the case, they would have had to apply to the court, for a fee, with no guarantee that the court would allow them to.

If you didn’t apply for this order, it would appear that the court is doing some housekeeping and requiring claimants to do their job as they may have not sent their own DQ… or the case will be struck out.

    Nothing to do with DQs.

The C has been ordered to file & serve a Reply to Defence.

Please show us when it arrives.

    On the case. 😊
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

They have discontinued the case, which has been a huge relief (and some elation).  I would like to thank everyone that has assisted me - without your time and expertise, I would have been another victim.  I will continue to pass it forward on this forum where I can with my own experience.

Here is the final 'Notice of discontinuance'.  The email came from DCB Legal on behalf of Highview Parking.

WELL DONE.   do tell your friends all about this utter crap from DCBL .... just in case they are they are subject to the same rubbish
