So that’s dropped through my letterbox now, the lovely people.Coupon-mad said:Ignore it and wait for the LBC.The broke down difference in cost even if I lost is £260, vs £160 if I pay now or £0 if I win obviously. So I’d say it’s a no brainer for regardless.0 -
Further to the above, I’m taking the draft from post 2 of the newbies thread and have dug out their email.Would anyone have some advice of any extra wording that would help in my circumstances?- I was using the just park app, overstayed for about 10/15 minutes then couldn’t pay retrospectively, machine wasn’t accepting payment (always faulty…)
Admitted that in the appeal (I know I know, should’ve gone with the standard response rather than being honest! But thought I had a good argument anyway)- I’ve been searching and scouring for the landowner to complain but it isn’t council owned and they haven’t got an email for who the land belongs to which is great. If I should just send as is with my relevant info then I’ll get it sent straight off. Thanks in advance to anyone who’s helped me thus far0 -
Sorry actually this IS a letter of claim. I haven’t even received a letter before claim… it’s gone from final demand to letter of claim. I open every letter and have not received an LBCWombwellBlade said:

A typical loss in court is about £200 , not what they claim
An LoC is an LBC, the newbies sticky thread tells you this in post 5, please read it, ( it used to have various names so various initialisms, but LoC is the current favourite. ) then read post 2 where the LoC ( LBC ) stage reply is also explained. So you would be wise to study that newbies sticky thread by coupon mad closely
You don't send anything off, you don't fill in any forms either
You email an LoC response to the lawyers, if used

Got a week holiday next week with plenty of time for reading as the great British weather will undoubtedly rear its ugly head - so I’ll be taking on whatever I can before sending the initial response email.Gr1pr said:A typical loss in court is about £200 , not what they claim

All in good time.Appreciate the advice1 -

SOME IDEAS FOR DETERMINING WHO OWNS THE LAND1. Google searches2. If a retail park, check on any signage which lists the on-site outlets3. Ask retailers on the site if there is a managing agent4. Ask retailers on the site to whom do they pay rent5. Contact the local authority and ask who pays the non-domestic/business rate for the car park (some councils have a spreadsheet on their website)6. Contact the local Valuation Office and ask if they know. They often have a website which might provide the information7. Contact The Land Registry and for around £3 they should be able to provide definitive detail8. If you haven't already done so, give us the name of the car park/site/location, we may have seen other cases there. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Just to clarify, have you received an LoC/LBC?LBCCC or have you received an actual N1SDT claim from from the CNBC?
If it is an LoC/LBC/LBCCC, the the second post in the Newbies/FAQ thread tells you exactly what to write back and why.2 -
Thanks for the suggestions. Google brings back very little bar some EV charging point info. I’ve tried the council to no avail and there’s only the 1 retailer on the site called Big Man Menswear which admittedly I haven’t tried yet. I’ll give them a ring on Monday.Umkomaas said:SOME IDEAS FOR DETERMINING WHO OWNS THE LANDUmkomaas and Fruitcake regularly post details on here on tracking down landowners or managing agents1. Regarding number 8, the car park is here: https://en.parkopedia.co.uk/parking/pall_mall_barnsley/?arriving=202406091630&leaving=202406091830
It’s called the Pall Mall car park in Barnsley - and the only point of contact seems to be Napier. The council don’t wanna know. All advice is very much appreciated

Judging on the comment above and after reading the small print, this ‘Letter of Claim’ is just the fancy new term for an LBC.LDast said:Just to clarify, have you received an LoC/LBC?LBCCC or have you received an actual N1SDT claim from from the CNBC?

Thanks“the owner of the car park is Napier Parking. We don’t really have much interaction with them as it’s one of these unmanned car parks with ANPR cameras so we never see anyone.I’m sorry I can’t be of more help, I understand how frustrating these car parks can be and we spend quite a lot of our time explaining to people that even the parking bays behind our shop aren’t ours and to avoid them.Kind RegardsTom”0
