    I get it that, in law, there's a distinction. But in practice I'm one and the same person! I don't want to go to court. 
    The same person but wearing different hats. Executor Gary doesn't have any cash. Executor Gary can remind the council of that (I presume you have already explained this to them). Executor Gary can assure the council they'll get paid as soon as the house is sold.

    Is anybody actually inviting you to attend court?
    I've explained to the council more than once that the house is the entire estate and that, once the house is sold, they will be first in the queue for all council tax owed (we're hoping that the conveyancing solicitor will pay it as part of wrapping up the sale). 

    I've got a letter from the council cordially inviting me to attend court on in May.

    Have you considered contacting the local Councillor for the ward the house is in? 
    I've got my own personal invite and I've explained the situation to the council several times.

    You may wish another chat with the council to see whether you can persuade them that their solicitor probably has better things to do with their time than both of you turning up at court.

    Given how little notice they've taken of all I've explained to them so far I can't see them being swayed by yet another repeat!
