  • Contacted the court via phone today. Got given an email for the court to send requesting adjournment with the reasons etc.. They stated that as long as I stated in my direction questionnaire that I would not be available, it should be fine, but it is late in the day.

    I'll wait to hear back and see, but I won't hold my breath.
  • Sorry, few quick questions as I burn the midnight oil to do my WS so that it's ready regardless of what happens.

    1. What format should my WS be in - PDF or doc? or does it not matter?

    2. If I reference other case findings, should I add the whole finding as an attachment to the email? What's the proper format to do it in?

    PDF of course otherwise it's editable.  This is a signed statement.  Can't be a Word doc (except to create it).

    No. You can't have multiple attachments.

    Put all exhibits in numbered order into a word doc then save it as a single PDF.  Then either merge the WS and exhibits PDF and compress it, or attach just the two PDFs.

  • Slight update.

    So CST Law submitted their witness statement exactly 14 days before the hearing. Unfortunately being away meant I have not been able to fully complete mine and have well missed the deadline. I emailed the court 7 days before the hearing to tell them that I am trying to get my witness statement done before the hearing and informed them that if the hearing is to go ahead, that I will not be able to attend in person, cc'ing CST Law into the email to make them aware as well. I had a family member visit my house to check for any letters from the court to see if they got back to me re an adjournment as a result of messing up the dates, but nothing has been received.

    To be honest, I had kind of resigned myself that I will now lose this due to not finding the time to finish the statement and the fact that I will not be in attendance anyway. However I have been cc'd into an email by CST Law sent to the court, less than 24 hours before the hearing, attaching a claimant's 'letter of excuse'. The letter state that the claimant will not be attending the hearing to 'minimise the Claimant's costs and in the interests of proportionality' and would like the court to consider the papers that have been filed before them to reach a decision in the matter, adding that their non-appearance is not intended as a sign of disrespect to the Court.

    I thought if they were not attending they had to notify the court 7 days before their non-attendance. Anything I can still do at the 11th hour? Worth writing today off to finish my statement and send it in so late now?

    Oh dear.  I don't know what to suggest.  Normally they'd be in big trouble for not turning up but you are also not turning up (why?) and you have breached the hearing order.

    The Judge will only have their statement to go on.  Nothing from you. I fear your username won't be borne out at the hearing.  You need to attend and you need a WS & evidence in.

    You have been very lax in dealing with this I am afraid. You had no reason not to challenge the hearing date on receipt 
    I am afraid you will almost certainly lose
  • As stated in an earlier post I am currently away on holiday (pretty much on the other side of the world) and whatever penalty the court imposes would have been minuscule in comparison to cancelling/postponing our holiday. When I called the court (it takes about an hour to finally get through to someone whenever I would call) they told me to email them about changing the court date, which I did, but I never heard anything back from them and an auto-reply states that they take 35 working days to respond. All well and good telling them they have to change it, but if I get no reply or eventually get told no, what could I have done about that? That pretty 

    I resigned myself to a loss today and didn't finish my WS (no point in wasting a day of my holiday for what would have been a certain loss I thought). Anyone know how I can find out the court result when I get back so I can pay the penalty as soon as?
