Scarily the first thing the judge said was "I strike these out all the time", but because it had made it through the first judge and our defence was a bit meaty she decided to really delve into it... Honestly its sort of my fault I didn't prep my wife enough so she felt confident in what to say etc... It sounded like it got a bit messy in which they insinuated she was just lying about her story to get out of a parking ticket and also that because there is hedge between the BP and McDonalds carpark she cant prove that she was ever parked in McDonalds Car Park, hence the 40 something minutes in BP (which isn't true, but we cant prove it as its MET's cameras and their privacy policy says they can refuse any requests they deem fit.)  She was a bit distressed to say the least and It wasn't very pleaseant for me to see knowing I'd put her in that position. I also didn't help by using a picture of the signage at night. But when asked by the rep/judge " Can you see that sign?" she naively answered "yes". So sort of architects of our downfall. Either way it didn't seem to matter about any of the defence and it was purely awarded to MET because we couldn't prove she had parked in McDonalds. Sorry there's a lot more I'm just not trying to bring it up at the moment as still quite raw.

Oh I'm sorry. It sounds like she was out of her comfort zone but tried her best. Had she said "no" to the question re whether she could see the sign in the dark, she may well have won. And with hindsight, had less detail gone into the defence, that Judge may well have struck the claim out for poorly pleaded POC.

Move on: real life important things (health, happiness, family & friends) matter far more. Give your wife a hug. You are more important than any scam parking firm.

Once it is less raw: please stick around as there was a final Public Consultation about the statutory Parking Code, literally due before the General Election.  It all stopped but is not dropped.

The Code and a wider regime of scrutiny and regulation of this rogue industry is coming.

I suspect that the Labour Government will need to dot a few i's and cross a few t's before attempting to get their version of the new statutory Code of Practice over the line. i.e. (without disclosing any work I'm involved in as part of the Steering Group) I think everyone reasonably anticipates a Public Consultation soon which you'll want to reply to, I expect?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
