You use the points that the Template defence tells you to put, either as para 3 or para 5 (depending on if you are using the optional linked wording).  Which is explained already.
The overstay was a direct result of my car breaking down unexpectedly. I had no intention to remain for that time but it was unavoidable, due to the nature of the situation. The signage was not clear along with poor lighting.
Would this ok? Or do I need to change?
No because the claim form doesn't plead "overstay" so you are not responding to that.

The penny will drop when you read the hharry linked defence example which I told you to look at.  Just go and use the Template Defence; come off this thread and go there.

None needed, I think?.  Every question in the DQ is already covered in the NEWBIES thread.  Always go there first.

  • Once completed do I email it to the same address as per my defence or is it a different email address.  Its unclear so I'm not sure.

You seem to have abandoned that check list you were following when you filed a Defence.

Item 9 on that list is worth another read, as is item 10.

Given that the CNBC changed all their email addresses overnight in February, it would be a disaster if you used the same old one you used in 2023 because your email will land in a black hole.

Please re-read the NEWBIES thread second post and the Template Defence first post.

  • Hi,
I have received my court regarding the claim. The Claimant has filed a defence but will not be attending in person.
Their defence has pictures of signs,  letters and claiming I was in breach of t&c's.
    Any advice will be appreciated.
    Thanks

The Claimant has not filed a defence.

They've filed and served their Witness Statement & evidence because the hearing Order gave you BOTH a deadline to do that.

    They've complied. Seems you haven't?

    Oh dear.

The NEWBIES thread clearly tells you about WS stage and exactly what exhibits to try to supply and it tells you that 'defence is not your only job'.  OK, how late are you?

If you snooze, you may well lose

Your court order gave the same deadline for the WS bundle to both of you, they complied, you haven't done, yet
