  • Sam, just to confirm ,on your initial PCN letter they didn't say they were using the POFA 2012 to track the driver down if it wasn't you?

    Yes they did.

The two types of ECP NTKs are shown in the NTK letters thread I started.

Thanks!  Sam is the PCN you initially received the old version which has not got the 'pass the notice to the driver" text in it?  If so that should be in your appeal and i can give you further info.

This is also the link to the thread of photos

But you just need to check your initial PCN letter and see if it is missing the text then if so i can comment further!

It that's not the missing bit and we don't need to check it for you. The linked thread covers it.

Sadly it has the 'pass the notice to the driver' part.

But the wording is questionable as it doesn't specifically say the 'if you are not the driver' to then pass it to the driver.

Okay so it may be worth including a part about the questionable wording. Anything else or does POPLA appeal look okay?

See what other people think but i think that you should say it doesn't correctly state what you should do as per POFA 2012 that should be a big item on your appeal.  Particularly state it isn't clear enough and doesn't follow the correct POFA 2012 statement

Are you at the stage where they have submitted their defence to popla?  If so check it as it is often a template copy and paste and has various mistakes you can rip apart

Where would I find their defence to POPLA?
