CCJ ISSUED AGAINST ME FOR SOMEONE ELSE'S DEBT

I briefly helped my husband with some painting of wardrobe doors which he makes for customers.
I helped for a few hours a week when having time off as a professional carer. My husband had a dispute with a customer which ended up with me getting a CCJ as well because he mentioned my name on his website as the person doing painting finishes! Surely this is not legal, to just randomly be able to have a CCJ issued against someone helping out someone else? I wasn't even paid for what I did!

  • Did you not receive any notification of the impending court proceedings?
  • The CCJ would be against whoever was the entity that the customer had the dispute with. It wouldn't just be 'randomly' served.

    The documents in the lead up to the CCJ would have specified who the customer was taking action against. What did this say and how does it compare to they way in which your husband operated his business?

    You can issue a summons against anyone at any time.  Whether it succeeds in Court or not is another matter.  Either way, the CCJ was not just "randomly issued".  There is a process.  You would have been sent a letter before action and a summons.  You would have been given the opportunity to submit a defense to the Court.  If you ignored the notices and took no action then the CCJ is awarded against you by default.

    Apply to have the ccj set aside as you're not a party to the contract.

    Setting a judgement aside costs £275.

    In the majority of cases it will just stay on file and not be enforced.

    If its not a major issue, you can just leave it, otherwise set aside information is here -

    Is this perhaps a CCJ against your husband's ltd company, of which you are a director? So not against you personally.
    Why did you not contest the CCJ? Did you not receive the documentation, along with your husband?
    You need to provide some context here.

    Why were you named on the business website if you were just a random individual. There's a clear inference of your involvement.

    I don't see the relevance if the OP's husband is a sole trader? Have they both received a CCJ?
    OP needs to provide proper info and context for anyone to offer meaningful advice here.
