    Thank you both, weller and smashed, for giving the credence that this thread so desperately needed. Debt is only money and there are many things, in life, that are more important than money - one of which is that being in 'debt' does not give the likes of the thugs that hide behind the label of 'debt collectors' the right to treat us as though we are something that they have just scraped off of the bottom of their size 16 boots.
    We do have rights and they must respect them.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

  • Thank you Rog2. I do appreciate that. I really wish we could do more on here. The DCAs are trying new tactics now like slapping folk with a stat demand as its much harder work for us to sort out. But we do sort things out. I am not going to claim anything back as such but what i have done is to gtry and get the OC to play ball. All this is far more worrying to people than bank charges. I did claim my back thank god. But people commit suicide over some the tactics used by DCAs. I know, I was almost one of them.

    I,ve been phoned several times in the evenings and saturdays, unwisely gave them my mobile number. Therefore should i consider saturdays as a working day? I repeat that on two of the letters from DCA ,That they state a debt has been purchased from the O C . Therefore under the terms of the CC ACT ,with the 12 day deadline expired , they cannot pass on the account . Also having contacted the OC when first contacted by the DCA, I was told they were no longer dealing with the account . So if I now do not recieve the requested paperwork from them , they are to delete my details from their files ! This is required by the CC ACT .

    They can state what they like, stapely - they are required to provide proof.

    Whilst the dca's may have no respect for what constitutes a 'working day' (some were even calling me on a Sunday) the 'Law' does. It is always better to respect the law than to bring yourself down to the level of these parasites.

    Got a reply to my second request today . The DCA say its the deed of assignment , a little doubtfull to me. Its a letter from the OC ,they say, looks like the OC headed paper . It states the account has been sold to the DCA . Looks like a printed signature . There is no mention of a request for a copy of the CC Agremment in there letter. The DCA state that they have requested a copy of the CCA from the OC. But surely they should already have this ? I will wait and see if they come up with it ! No news on my first request , 13 days till deadline.

    I,ve a hearing lost claim at the solicitors at the monent.So with the requests for the CCA,S i will insure when i make a final settlement offer ,it will be to the correct people .
