Hi, a while again since i have posted here. A happy new year to you all. Right. It is a hard fight when it comes to the DCAs and CCA requests and getting defaults removed. And you need broad shoulders to cope with it. This is NOT DEBT AVOIDANCE. But it does clarify who you should be paying the debt too. Also as i have an aquaintance in the debt collection industry, i also know that the majority of debts are sold to them. For as little as 6p in the pound. Not many are for than 20p in he pound. I requested my CCAs from all the DCAs. I too was being chased by 3 DCAs for the same debt. Not anymore. Incidently i have since paid the original creditors what i owed them. I have read this thread with interest. Thee are many many people asking for the CCAs but its mainly on Consumer action Group. I have no problem paying the monies i owe butcertainlky not an inflated amount. Also reclaiming money back from a DCA if they cannot supply an executed credit agreement is very very hard. But i have found you will not hear from them again. It does give you some leverage though to negotiate with the OC to pay them back in your time. Asking for your CCA will also highlight if you have been landed with any PPI. Or if PPI is not on the CCA but you have been charged for it then you can claim it back. AND it is also worth checking your CCA to make sure the figures tally. I had a hand written one and the interest had been worked out wrong and it made quite a differance to the final figure. It turned out they ended up owing me money. Good luck everyone. Not only should you check all 3 credit ref agencies but request your CCA as well. Costs you 1.00 for each one. Could I just ask weller and smashedbooboo - this is one thing I'm not sure about.... If the original creditor has sold on the debt, does that not mean they will have nothing to do with it? And therefore isn't it a bit difficult to negotiate paying them back? Or are you talking about debts which hadn't been passed to a DCA in the first place? For example I had phoned a creditor (original creditor) about a debt a while back but because it had been passed on to a DCA they didn't want to know about it...
Also - does it make any difference if the DCA is an 'in-house' agency?
Any advice on those points much appreciated (hope the OP doesn't mind but this is an interesting thread and I think it's as good a place as any to clarify and ask). I also think I'll pop onto the CAG and have a look there.Proud to be dealing with my debt!

Hi, ok, after i asked for my CCAs and the DCAs could not provide them they passed them back to the original creditor. Then they usually passed it onto another DCA. You know the thing. Round in circles. So request CCA from new DCA. Eventually you will be able to get to OC and work things out. CAG have all the template letters. I went through CAG. But started off here. If the DCA has not got the original CCA you may well find that they pass the debt back to the OC - who you can then request your CCA from again, in my opinion the OC is more likely to deal with you re: arranging a suitable repayment plan that you can afford and stcick to.
This might not be the case and so it will get passed on to another DCA and yet another and so on and so on. Just keep CCAing them.
You can CCA the OC in either case - whether the debt is with a DCA or the OC - once they have supplied an "alleged" CCA you need to find out if it is a true CCA ITMS.
If the OC has sold the debt on then the DCA has a legal obligation to provide you with the true signed copy of the original executed CCA whether or not they are the original creditor or not and they have also to provide you with a Deed of Assignement confirming that they have the legal right to collect the debt. If they happen to provide both of these and they are in proper order then yes, you have to pay. This will, or should mean, you should have no further contact with the OC.
As for in house DCA - I am currently having a battle with Blair, Oliver, Scott (Bank of Scotland in house DCA) they have not provided me with a true CCA and I have informed them of this and they have now passed the debt on to another DCA - B, O, S have now been reported to TS and the OFT. I am now awaiting the outcome of this.0 -
I agree with Smashed - go to the CAG - I am on there frequently :rotfl: and even though I know some of the answers I just keep asking, clarifying things and somebody will always help, tell you what to do next, who to report them to, what letters to send etc etc - they are a lovely bunch and know a lot more than I do. I think they think I'm thick but never say so - I just need to be sure of what I am doing so i just keep asking and then learning.
Knowledge is power - read all you can and ask as many question as you can. And if needs be, ask and ask again.0 -
I agree, There is no site like this one, but on CAG there are a lot of legal eagles helping out or trainee legals. Also one hell of a lot of self taught people on there. Through experience. We are a lovely fluffy friendly bunch over here. Over on CAG they are very friendly but in another way. You wont get the frilly bits like you do here. But they do get the job done. I have said it before, i really think it would be worth having a sub forum for the DCAs and the like. Template letters etc on here. Have a read through some of the threads over there. Awww thanks both of you - that clears things up in my head a bit - and made me realise again that I'm just at the start of this road!! I'm on my way to have a nosey on the CAG now!!Proud to be dealing with my debt!

Jst sign up as you would on here. The section you are looking for is is under the section that has General, bailiffs, and then debt collection agencies. Its th Dca forum you need to ask yur question in. The template letters re in thge general section. 2 above the dca forum. The letters are part of a sticky and the original poster was barracud. Hve a read through first to see if anyone else has something similar going on. As i said earlier they re a friendly lot but they are straight talking ad do notwaffle like what i always do.
