    I've been reading about the trend of DCBL discontinuation, and like clockwork just received a phone call from DCBL asking if I wanted to settle out of court. I said no, because I am going to win in court. Hoping to receive a discontinuation letter soon.

    As for "evidence", what do they show on their appeals website? All their photographic evidence will be there.

     I've just tried to do this and getting the error message "sorry we can't find this ticket"

    I'm struggling with how to pen the witness statement to describe the events of the day when I am being pursued as the keeper, not the driver.

    Is it advisable to simply talk about the conditions of the car park, locations of signage etc, or talk about what happened on the day.

    If you are the keeper, you could narrate what the driver has told you about the events of the day. You could have gone to the location of the alleged breach and seen the conditions for yourself.

    Straight away I can see that you have missed at least one instance (more like 5 or 6) of "the defendant" whereas it should be "I" because it is a witness statement and you are the witness therefore use the first person.  Does what you are stating correspond with what you wrote in the defence?

    I am afraid I must have slipped up and did not mention anything to do with signage or specific issues with the car park in my original defence. Does this mean I am not able to rely on any of this in a hearing?

    You can ALWAYS bring up unclear terms and notices because that is your right in the Consumer Rights Act 2015 and does not have to be previously pleaded in defence (see s71 of the CRA).
