  • Coupon-mad I joined forum yesterday so not yet. I will look at NEWBIES properly and use any relevant text for getting contract with land owner. Thanks.

    I managed to track down the land owners of the Fairlawn car park in Southall. I called the local council who couldn’t help except to use the land registry. Since the car park is behind temple I guessed it might be them. I was correct however the man (won’t mention names) I spoke with was very unhelpful and rude. He said abruptly they have contracted Parkingeye and I should speak with them. He cannot do anything. This is after telling him I visited the temple when in Southall. Of course it’s the last time I ever visit that temple. Landowner is a dead end. I think I may just have to pay up.

    You don't just pay up! What did the landowner say when you told them it was their (well the parking company's faulty equipment) to blame? You go back to the NEWBIE sticky and see that you send a robust response to the Letter before Claim.
  • Le_Kirk thanks but during POPLA appeal Parkingeye gave stats showing machine was working during the time I was there. Perhaps it was my card or user input error. Also POPLA said I could have used the other machine and telephone option. Of course at the time due to rain I didn’t pay attention to other options (in my mind it was only one) wanting to leave the open car park for one that was covered. The implicit contract based on time means motorists can’t change their mind! I haven’t given up yet so will reply to LBCCC. Even if I pay up I will pursue this unethical behaviour with my local MP for the benefit of others. 
  • I should correct myself as I think that there is entry grace period of 5 minutes where motorists can change their minds and leave. Also I think an exit grace period of 10 min for those who parked. That’s if you know BPA rules as there is no sign at entrance or anywhere mentioning grace periods to inform the motorist. It’s very odd considering implicit contract is based on time and grace periods can differ depending on size of car park. I intend to use this as one of my points in reply. According to POPLA motorists need to educate themselves! This is coming from an impartial adjudicator.

    But that doesn't happen.  You've read the second post of the NEWBIES thread?  There is no risk and 'costs' don't spiral.

    Fortunately POPLA decisions are not binding on the motorist.  The machine stats might show it was working but if it was, why did it fail when you tried to pay?  As @Coupon-mad writes, no paying!
