Thank you!!When you get a chance can you tell us more:- did a rep show up? What did they say?The rep showed up, very lovely gentleman we got chatting as we waited for the judge and he wasn't aware that there were no signs at the entrance of the car park. And he had won cases the previous weeks for his client in regards to the same car park.
But when we went in the judge wasted no time as he said he had gone through the documents and there is a significant point which sticks out.
The claimants ws suggested they know the carpark well and everything they provided as evidence was true. But in my WS I show that they have no signage at the front of the carpark.
Essentially the judge said they submited false information to the court. And the rep was told to feed that back to the claimant.- what was 'unreasonable'?It was deemed their behaviour was unreasonable because had the claimant looked that my ws and defence any reasonable person would have settled the case before bringing it to the court.
I explained I appealed several times showing the evidence that the sign wasn't there prior to the alledged offence and also post the alledged offence and the judge agreed with me. So he awarded me my requests as the rep was asking for the standard fee as according to the white book.
But the judge said it was a case of article G ( I don't fully understand that) which means he can award a higher fee if a party has behaved unreasonably.
It was also requested that the rep ask for the ability to appeal any larger amount.
But the judge refused the ability to appeal his judgement and ordered they pay me within 14 days.
It's a shame I couldn't add to the discontinuation thread but you guys have been truely amazing.7 -

Bank Park ( IPC AOS member. ) must be sorry they started this case, the better person won , better evidence too
Just goes to show they don't check their facts, or lack of evidence to support their assertions that the parking company are always right. ( Not. )
DCB legal clearly failed their client too
Nice to read this case. ! ( It would be great to know the ballpark figure that they have to pay out, once its in your bank account )1
