Holiday Chargeback??

Hi all, apologies if this is in the wrong category.
I would just like a bit of advice re a holiday chargeback and would like to know if I have a chance or would get denied basically.
I booked a holiday to a 5star+ hotel in Ayia Napa, there was about 30 of us. Everything was ok until we checked the jet2 app about 2 weeks before we were due to leave and half of us had our hotel changed to a 4star, they never informed us of this, they said they sent a text to me but there was 15 of us that never received the text.
They said this different hotel was the only place they could fit us all, and it was like for like, they offered us one in protasis, so with it being so close to the holiday we felt like we had no choice but to accept it and also because we were attending my brothers wedding so we all couldn't exactly say no we'll just cancel the holiday instead.
Anyway this hotel was an absolute dump, there's pics, and statements from us all sent to jet2, it was made worse by one night picking up a few people from the original hotel and seeing how out of this world the originally booked hotel was, especially compared to ours, after arriving home we since found out that jet2 upgraded our hotel from a 3 star to a 4 star and downgraded the originally booked 5star plus to a 4 star, this in their eyes justifying the replacement as like for like.

Cut a long story short we complained, they offed us £200 compo which I rejected and they won't budge.

what I am wondering is, can I claim off my credit card for being misold a holiday?
it wasn't what we booked originally, also there was no refund of the difference because jet2 said the hotels are the same price, this despite one person cancelling with jet2 and booking the exact same hotel board and nights for £1.5k cheaper.

I know its long so thanks for reading.

  • A chargeback would almost certainly be immediately reversed.

Which leave you with s75, which will need to to prove to the card company that you didn't get what was promised and that the terms were breached.

You're probably better off continuing to press the holiday company.

Chargeback would be a nightmare. You would need to prove everything to stand a chance. Even then there is the issue you still stayed there. So a refund, when you have used the hotel will odds on not even be taken on.

    Who paid for the booking?
Did you pay for everyone, odds on S75 is not going to cover the whole group.
If each payed for their own part, they would have to go via their card co.

There is no evidence in the original post that a credit card was used for payment and even if they did use a credit card you will have the problem that there is no creditor/lender association for 29 of the party.

Well, there was this, so, unless OP was being insanely optimistic, it seems a reasonable conclusion that this was the payment method (for him/her at least):

Do you want me to see if I can get a copy of the OPs credit card statement?

I'm a bit busy tonight but I could maybe pop round tomorrow?
  • Can you identify the hotels - that would be helpful to judge other guests opinions online.
  • Thank you everyone for the replies.
A couple of things to add.
I paid for my family on my credit card, all the other families paid separately so this wasn't a wedding package.

The original hotel we booked was the Chrysomare Beach hotel and resort, the hotel we ended up staying was The Dome beach hotel and resort.

I have screenshots from where the Chrysomare was a 5 star and then downgraded to a 4, screenshots of the prices per night at the time, which was £202 per night for the Chrysomare and £94 per night for the Dome.

The original reason for the move was jet2 said they lost the contract for the hotel, funnily enough on the morning of the day I rang up to query the hotel change. We since found out this was not true and they stopped selling holidays to that hotel before the turn of the year. Also we have been in contact with other holiday makers who the same thing has happened to them and where told jet2 lost the contract 5 days prior to their holiday but this was more than a month after our holiday ended so clearly something doesn't add up.

There would be phone records of all this happening.

The thing is I have not been seeking a whole refund to begin with just the price difference in accommodation and the cost of 40 euros a day in taxis just to get to Ayia Napa to meet up with the rest of the family, I also spent a grand on food because the food was terrible at the Dome, compared to the Chrysomare which was top quality.

I have tons of pictures from hotel room doors not locking and coming back to the room with door wide open to hotel staff walking around smoking in the hotel, tons of videos of the chrysomare and the quality of the rooms the service and the food, pool side snacks etc. Honestly they are a world apart so I just wanted some compensation for the drama and stress etc so for them to offer me £200 its just damm right cheeky.

    TBH.
Give you card co a call & explain the situation & see what they say.

As long as the card owner was part of the group and it was on a single booking then that shouldn't be an issue.
    That establishes a direct link.

I think the biggest problem here is that the OP accepted the downgrade and didn't just insist on a refund. Their comment that they couldn't (due to it being a wedding) won't really wash as there are more than two hotels in Cyprus - they could have easily taken their refund and went elsewhere on the island.
