Surely they said they were unavailable for a hearing for a month before and the month after, at least.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So my court date is Friday, i dont even know what to say, will they take into consideration it was a free car park where i had swimming lessons? Does the judge just make decisions based on the defence we submitted?0
-
I also have my court case this week and keen to understand what I should expect, do I just reaffirm my written defence?0
-
This is a normal stage and hearings are already covered in NEWBIES PLEASE READ THESE FAQS FIRST.
I really hope you both read the second post of it earlier this Summer and DIDN'T just stop at sending a defence months ago (a Witness Statement/evidence is required, as was directed in your respective Hearing Orders).
If either of you hasn't done a WS bundle, do it TODAY or you are effectively not a witness and can't speak at the hearing unless the Judge is very accommodating.
Read the WS & evidence examples in the NEWBIES thread, open a Word doc now and copy & paste an example in and amend it to suit your case. Today. It can be emailed (and obviously not to the CNBC at Northampton).
Hopefully you both already did your WS bundles and I'm worried about nothing!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Your defence was submitted to the CNBC. If you’ve been allocated a hearing date at your local court, you should have followed the advice in the Defence Template thread. Did you?
I can see why @Coupon-mad is worried. The defendant ought to be worried even more.1 -

I've been back through my paperwork and the letter from the court did not stipulate a deadline from this (the original court date was moved) - it was almost as if a page was missing - I've been back through my paperwork and double checked this.
The WS and Exhibits have been sent to CCBCAQ, the local court at Leeds and the VCS legal team.0 -

The Notice that gives the hearing date.Is there not a paragraph something like:Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].Might be on the back. Those 'documents on which you intend to rely' are your Witness Statement and evidence.
I note that you say the hearing date has been moved, but if there is nothing to say your filing deadline has also changed, then that information on your Notice of Allocation remains good.bn06ash said:The WS and Exhibits have been sent to CCBCAQ, the local court at Leeds and the VCS legal team.1 -
Case was today and I'll put comments in the relevant thread to avoid confusion.
My defence wasn't considered as I'd missed the deadline, the Judge accepted my candid apologies - I did however manage to make the necessary defences (admittedly pretty much on the fly) in the hearing.1 -
Oh i didnt even complete a witness statement. Il try and email one now.0
