Property disregard rules for care home fees if a family member lives in the property….

    With regard to the question about Brie, it may well have depended who paid for what and also the very short timescale in between Brie moving in and mother-in-law having to go into care. That would not be a typical situation so can’t really be generalised from.


    Thank you for that info, That it's voluntary was def not something my parents were told  at the time. I knew I remembered starting a thread about it.

    ETA- Now I've re-read I think what you're saying is a 3rd party can't be forced to pay these charges but unless someone is willing to then you can't be at a place that does charge the extra fees (or have to move somewhere cheaper).

    At the point my parents were told this, my Nan wasn't in a care home. She was in a (NHS) residential assessment centre, having been moved there from hospital. During her time there her home (owned outright - no mortgage) was assessed to see if it was suitable for her to return to. It was decided it wasn't. Nan's home was sold to pay for her care, so I still think my parents were given incorrect info at that point as Nan was self funding.
