Transitional protection moving from rented to mortgage

Hi Guys, 

i was wondering if anyone had any experinece with moving from TC to UC and also leaving rented and going in to a mortgaged house, as i have to migrate before 1st december.

I currently get about £230 TC and would be entitled to £200 UC so will get the transitional protection for the difference.

In Feb i will hopefully be moving and this house will be mortgaged. This means my entitlement for UC would be 0. If i was still on TC i would still have a small entitlement. of around £23 a week.
Would this be honored as part of the transitional protection?

    When you move house to your mortgaged property in Feb you will have no entitlement to housing element, if this reduces your UC to zero because of earnings then it means there will be no entitlement. TP will not cover that.
  • Yes it will reduce my claim to 0 because of earnings, however if i was on TC and had a mortgage i would still be entitled- is that not what transitional protection is for?

    No, not a couple of months after you claimed it isn't. It's just unfortunate for you that you're moving house after you claim UC. However, UC is based on earnings received each assessment period, so if your earnings fluctuate there could still be some entitlement.

    There are a few points here (and I'm assuming here that you are not on Housing Benefit, as the vast majority of UC migrations are tax credits only cases, and you haven't mentioned it in your post):

    1. I dont know how you have calculated your UC entitlement, but if it includes the housing element then it is almost certainly wrong for it to be lower than your tax credits entitlement.

    2. Moving to your own home should not affect your TC entitlement.

    3. Transitional protection is calculated before the housing element is considered, so you should still be entitled even after the housing element is removed.
