How long for bank dispute to obtain money back?

Long story short I am rejecting a car with a garage who are digging their heels in and not giving me my money back. I have contacted my car insurance Legal Cover, who are "assessing my case" and deciding the likelihood of success, and that will determine whether they take it on.

As a separate avenue I have also contacted Lloyds to raise a chargeback dispute (payment was made by debit card). They will take 5 days to review the evidence I have provided, then again if they feel there's enough of a case will initiate the dispute.

Has anyone ever done a dispute for a chargeback with a bank (for a debit card) and can advise on how long it took - have tried to google but have not found much.

The garage are wanting to charge me storage costs per day hence why I would like to get all of this resolved quickly. I was happy to just trot along the legal route and it take as long as it will take, but those storage costs per day £££ will add up over time!

A few points: The car was purchased from a car supermarket type place, 4 year old £12,000.00 by debit card.
I have given the garage the aa breakdown report and they are basically refusing the rejection advising the fault was caused by the battery which they have now changed. Having spoke to my local garage who say the original fault/sensor code is unlikely to be the battery, I still wish to pursue the refund.
I had the car for 2 days before rejecting it.

If (after their initial review) Lloyds agree that it seems to be a valid chargeback then they should refund you straight away, while they liaise with the merchant - if the merchant challenges the chargeback (as it sounds like they will) then your bank may then reverse the refund if they side with the merchant, so chargeback doesn't really resolve a dispute as such, it just provisionally returns money to the customer.

There is no set timescale... you will often hear people saying that the merchant has 28 days to respond else you are awarded in default but that doesn't consider it takes time for it to be passed between the banks and processed by the merchant bank and likewise when the response is received it takes time for it to make it back to your bank and them then consider the two sets of evidences. If they can't get to an agreement it then goes off to Visa/Mastercard for adjudication.

Most banks will refund the money straight away but note that they will recharge you if the chargeback is ultimately unsuccessful.

  • @DullGreyGuy all clear, thank you.

If it goes to Mastercard/Visa decision - is this very swift or can it take some time? I'm suspecting the garage are going to object....

Its what you'd expect from a non-customer facing company... it'll take longer than you would like but not months (from when it goes to them)
  • @DullGreyGuy Thank you! Funny thing is im happy for it to take a bit of time and bide my time until I get my large sum of money back - but it's the garage putting the pressure on with the storage costs per day which will now increase my stress levels!

Perhaps also worth considering that the merchant isn't in any way bound by Mastercard/Visa's decision, so can still pursue you in court for (what they claim to be) the debt.

You might wish to repost the non-chargeback aspects of your issue on the consumer rights board, as the broader matter of you exercising your short-term right to reject under the Consumer Rights Act is still a key point....
  • hi @eskbanker thank you for your advice.
In what way shall I repost my issue also on the consumer rights , maybe to ask what other options there are, is that what you mean?

Effectively, yes - you mention that you're cutting a long story short and are looking at chargeback, but, as above, that may not actually resolve a dispute, so is really addressing the symptom rather than the cause, i.e. the seller doesn't have the legal right to refuse a valid rejection on the basis of having effected a repair.  It sounds like their attempt to levy storage charges is a clumsy attempt to get you to settle on their terms, so it seems to me that discussion of the whole situation with those who know more about consumer rights may be worthwhile, rather than focusing specifically on bank chargeback procedures?
  • Okie doke , thank you so much I will head to the consumer rights board also : )
