Is/will be in the new Parking Code of Practice temporarily withdrawn:-

    "7.3 Use of photographic evidence
Photographic evidence must not be used by a parking operator as the basis for issuing a parking charge unless:

    d) images generated by ANPR or CCTV have been subject to a manual quality control check, including the accuracy of the time-stamp and the risk of keying errors.

    1. The manual quality control check for remote ANPR and CCTV systems is particularly important for detecting issues such as “double dipping”, where image camera systems might have failed to accurately record each instance when a vehicle enters and leaves controlled land, and for checking images that might have been taken other than by a trained parking attendant (see Clause 15).
  • This is, I believe, what the experts on here call Plan A. Good to see it worked and common sense prevailed.

I contacted Castlepoint today and explained the situation. The lady was very abrasive but did agree to contact the parking firm and request it be overturned.

Fair enough,  I received an email saying it was sorted. Checked online and no more live case.

    Happy days.
Why does she think it's acceptable to be abrasive to customers scammed by a double dip ANPR error that saw your data wrongfully taken and processed by an aggressive 'rogue' industry?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Glad the advice worked. Less than 24 hours later - PCN cancelled. Plan A strikes again. Off you trot UKPC, at least it won't now involve you paying DCB Legal to issue court proceedings that would be discontinued later. Actually UKPC, the forum has saved you some money. How about donating the saved amount to a local charity?  Now that would show a caring attitude towards society at large.

    Shhhh 🤫. I don't think we'll hear anything somehow!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
