So I got an NTK in September about overstay parking at the same car park I have a historic issue with & am currently awaiting a court hearing about, although it was a different parking co. at that time (Spring Parking) but I have had enough of these predatory vampires!
Using info gleaned from here, I appealed directly to Smart Parking having received the ‘fine’ over a month after the alleged infringement.
I wasn’t holding out much hope as Smart parking are well known for non -pofa reliance but Yesterday I got a letter saying the case was cancelled! so I thought I’d share in case the template helps others…

Sorry to drag up an old thread! I want to use your appeal as mine, I was in a hire car from a car dealership when I supposedly contravened the parking restrictions set by Smart Parking (4 hours free)

They have sent the charge to the dealer who has ‘named’ me as the driver, however I will defend that I was simply the hirer/lessee.

Can I use your appeal wording, regarding POFA etc?

They also only issued the PCN 26 days after the incident. Thanks in advance!!

Yes.  Easy one.  But you can only appeal once your NTH arrives addressed to you.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Perfect, thanks. So I actually need to ask the car dealership to contact Smart Parking to give my postal address, as the hirer of course not driver.

Of course. I don't understand why nobody there has any idea how to transfer liability, which is really simple and obviously requires them to provide a name & postal address.
