Smart Parking -Easy win!

So I got an NTK in September about overstay parking at the same car park I have a historic issue with & am currently awaiting a court hearing about, although it was a different parking co. at that time (Spring Parking) but I have had enough of these predatory vampires! 
Using info gleaned from here, I appealed directly to Smart Parking having received the ‘fine’ over a month after the alleged infringement.
I wasn’t holding out much hope as Smart parking are well known for non -pofa reliance but Yesterday I got a letter saying the case was cancelled! so I thought I’d share in case the template helps others…

  • I've just received two parking demands/fines from smart parking for £100 each for parking on a private road, this road is ANPR monitored and I was parked there for less than 10 minutes on both occasions, they have a sign on a fence with the parking terms and conditions and it says you must remove your vehicle within 10 minutes of entry, I did yet they still sent out fines, they're getting nothing and I've replied with photos of the notice board, a photo copy of their demanding letters and my letter pointing out the times I entered and left, I have said I deem this now finished 
    I have also said any more correspondence from them to myself regarding payment I will see it as harassment and sue them

    Brave words, but unlikely. Ignore any subsequent debt collector demands. Come back on your own new thread if Smart issue court proceedings. About as unlikely as Boxing Day not falling on 26/12!

    If you'd simply appealed as keeper (as on this thread, the non-POFA point) they'd have cancelled.  Other newbies take note.

  • Hiya, thanks so much for the advice, it really assists me for my appeal. Quick question - re the 14 days - is that from the date of contravention to when PCN received in post?

    Yes, but the 14 days is neither here nor there. Even a Smart Parking NTK received after a week is non-POFA.

    All Smart Parking NTKs are non-POFA worded.

  • I'm dealing with Smart parking on behalf of my father.  We have submitted an appeal based on the debit collection notice, based on no NTK in the first place, but have only just received the NTK today, some 74 days after the contravention. I want to submit a no liability to keeper appeal based on the above, but can I add further submissions to an appeal already lodged or is that it and will I have to appeal via POPLA if they turn down the appeal. I've tried to resubmit on Smart parking's website but it's not allowing me to submit.  I assume because there is already an appeal in place.
