If it's a single PCN then the CCJ is well under the £600 that could see HCEOs come knocking.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have had confirmation of my hearing date, 19 Dec!
I feel ever so slightly panicked, I wasn't expecting it this side of Xmas.
Any advice on what I should do in preparation?0 -
CCJ set aside?
Read the six cases linked in the NEWBIES thread which all tell you what they took to their hearings and what happened.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

On it. Thanks C-M.0

I have been reading up.
Just wanted to clarify a couple of things with you knowledgable people!
I received an email on the 2nd Dec with the notice of hearing. It just listed the date with no further orders or actions required.
The covering email said that sealed copies would be sent to my house - I still haven't received a letter, so i have sent a chaser email.
Will the documentation sent in the post be the same as the email copy?
I ask because i other peoples cases they have been supplied dates in which they had to provide further information by. My concern is I will receive it in the post (late!) and will have actions required with little time to prepare.
Thanks

You shouldn't need to submit anything else, as this is a CCJ set aside hearing and you've already submitted your bundle. But I would expect a paper copy of the Hearing Order. If it's an in-person hearing, get there half an hour early and sign in with the court usher. Take proof of paying the £275 fee, and your wage slip or proof of 'loss of leave' for attending this hearing, and ask for all those costs to be ordered to be paid by the Claimant, at the end before you leave the room.PRIVATE 'PCN'? Thanks for the information.
Should I prepare a Skelton argument to present to the judge?0 -
If you want to clarify the legal arguments. Most people have it already well covered in the set aside WS.
Do not bombard the Judge. This should be simple. Don't forget to ask for your costs!
If you could reply to this Inquiry that would be superb. ...
...only 4 DAYS left to do this VERY relevant Inquiry linked & discussed here:
Really relevant because the reason there are delays in the work of the county court is because up to a THIRD of all claims under £1000 are parking.
Your paperwork will be great evidence. This is about showing how parking firms abuse the court service and cause CCJs. There should be a bespoke private parking protocol to resolve cases without court, and which forbids PPCs from using old addresses.
I think if enough people say the above sort of stuff, this Justice Committee will go and talk to the DLUHC guys I'm dealing with, and hopefully recommend a new pre-action protocol to stop CCJs.
