Stuck between a rock & a hard place (aka Peugeot and Motorpoint) - what are my rights?

The short version of my story is I bought a second-hand car from Motorpoint and 1 year later it developed a fault, but as it was under warranty it was taken to Peugeot. Peugeot have tried to fix the vehicle three times this year (same fault), but I never get more than a few weeks out of it before the fault develops again. They've puzzled over it at the dealership for months, they've had Peugeot Technical involved, they've replaced various parts and they simply can't work out what's going on.

When I got it back again a few weeks ago, I was advised to run it for 600-700 miles and to then bring it back in for a courtesy check up, which didn't fill me with confidence. 450 miles later, the same problem has occurred and we're back to square 1 again.

I want to reject the vehicle. It's unreliable (I'm self-employed and need my car for work), it's unsafe (having cut out on me twice on the motorway at speed) and I'm done with going round in circles.

Peugeot have said that I can't reject the car as I didn't buy it from them and so I should contact Motorpoint.

Motorpoint have struggled to honour their own commitments with regards the purchase so far and they see it as a warranty issue for Peugeot to resolve.

The Ombudsman has a 6-month waiting list and has said they can't deal with a case like this. 

So here I am completely stuck and open to any and all advice. What are my rights? What should I do next please? Thanks in advance.

    Your consumer rights are with the retailer not the manufacturer, but a year after purchase the onus is on you to demonstrate that the fault was present at the time of purchase, so you'd need to engage an independent expert to advise on that.

    Separately, you may have rights under the manufacturer warranty, what do its terms say on the subject of not being able to resolve a problem?
  • Thanks for responding @eskbanker . I don't think we'd be able to demonstrate that the fault was there on purchase given it didn't develop for 12 months, so that just leaves the warranty avenue. I can't find the exact T&Cs that cover this scenario, so I've asked the dealership to provide them.

    Consumer rights are with MotorPoint, but after this time you will need a independent report to back up your case.

    Have you tried another dealer? They might have more knowledgeable techs. How did you pay for the car?
