Compulsary recall caused issue that significantly devalued car - advice please!

A good friend who is also a very competent and professional mechanic has said the same as you.
We are just going round in circles with the dealer, repeatedly asking them for proof of the actual mileage the car has done as this would support a potential section 75 claim against the CC we used to pay the deposit, which they will not produce for us.

If you have no success then Carly might be able to extract that, but really brutally you need INPA to pull it out of the relevant modules.
Personally call BMW UK but be persistent in asking for the technical support side.
It might be worth seeking a bmw independent near you as many will have access to INPA, depending on your location I might be able to recommend a few.0 -

Bmw's diagnostic software is some of the most advanced out there. It only needs to be plugged in now to flag remaps which has caught a number of people out.0 -
Why did BMW alter your speedometer reading, was it part of the recall?Not sure why they would do that, unless they were asked.0

Apparently the reason the mileage was reset is because the clocks were damaged during the clocking. When they reprogrammed the ECU as part of the recall, this then caused the mileage data to be lost from the clocks.
They have thrown various phrases at us which all vary, they have insinuated both hardware and software issues. I am not convinced that they know exactly what they have done.
I think as you suggest ninja59, I will have to explore an independent BMW workshop and explain the situation and hopefully they can give me the information from the other modules.0 -

You might also have an problem with proving that the issue was there when you purchased the car - particularly if the BMW dealer are not being supportive.0 -
Holding on to the vehicle until yours is fixed would not be theft under the terms of the theft act. That states that you have to be permanently depriving the rightful owner of their goods. Had this with Dixons some years ago when I refused to hand over a loan TV set until they fixed a TV under SOGA. They wanted to call the police - I suggested they not waste the police's time over a civil dispute since I wasn't aiming or wanting to permanently deprive them of their goods, so I wasn't committing an offence as defined by the theft act2
