BW Legal ??LBC

Hello,

I’ve received an email from BW legal saying they’ve been passed my file by GXS Services for an alleged parking violation at Shoreham Harbour. Not unexpected.

my question is, can an LBC be via email or does it have to be a letter through the door? They’ve given me 30 days to reply and there is a link to their “customer portal” on the email. It states further action may be more emails etc or a letter of claim.

is this an LBC or so I wait for the letter from the postie?

    As long as the LBC is sent as a pdf attachment to an email, it can be considered as a valid LBC. Just sending the content of an LBC in an email could be argued as to not comply with the PAP.

    The PAP only states that a "letter" must be sent. It does not clarify how that "letter" is sent and does not state that it has to be by post. Service of a letter as a pdf attachment is normally an accepted way of delivering one.

    In many cases, legal documents, including letters before action, can be sent by email, especially if both parties involved in the dispute agree to electronic communication.

    The content of the letter must follow the correct PAP as pointed out here:

  • Many thanks. Reading the email again then, this is not an LBC and the link to the customer portal takes me to a form that I have to fill out with all my details (not doing that) and states that it is a pre-prepared payment plan. No formal letter attached in PDF or reply forms either. I’ll wait for a proper LBC or just the claim letter before replying unless anyone advises or suggests otherwise. I’ve read the template response to use when that time comes.

  • Nothing to do until you receive either a real LBC/LoC or an actual claim from N1 from the CNBC. You seem clued up having read the second post of the Newbies/FAQ thread on what to do and by when.

    This is sneaky.  Seen it mentioned in a QDR case today as well. 

    I suspect the DRAs are sending that email.  
    What email address has it come from?  One that we know is a BW one or not?

  • Thing is, these little monsters from the dark side are up to any trick to extort money.

    But, BWLegal WILL ADD A FAKE AMOUNT 
    The fake amount comes about because the BPA said in their stupid code of practice said they could.
    This is cloud dreaming from the BPA and BWLegal  actually believe it's true ?  

    NON of this has any legal authority and Judges know this

    Dear BW Legal,

    People who do not pay unfair 'parking charge notices' have not done so by 'oversight' or due to 'difficulties'. But you know that already.

    In my opinion, charging £70 to set up 'payment plans' and calling this rip-off set up 'debt resolution' smacks of just the sort of "extorting money from motorists" that was exposed by the DLUHC in 2022.

    I don't have an 'account' with you. These letters are intimidating harassment and I look forward to the end of the menace of 'parking bulk litigation' next year.

    Put up or shut up.
