Advice plz, QDR Solicitors Court claim and Statement of costs - Now with PoC

    It's not a "fine". You'd be lucky if they would let you "pay up the original fine" now. You are at claim stage. If you pay them what is on the claim, you are likely to pay more than if you lost at the hearing. As mentioned, even you lose, it is likely that the judge will only order that you pay the original £100 charge, possibly plus interest, plus the £85 hearing and legal fees. So around £200. Then again, the judge may take into account the CRA argument in your defence and throw out the claim.

    At this stage, you are probably better off attending the hearing than just trying to pay the scammers what they are claiming. As mentioned, even if you lose the claim, as longs you pay any CCJ in full within 30 days, there will be no record of it.

    Next time, at least you know where to come for advice before you do anything rash.

    Just do a WS this weekend and email it. Better late than never.  Have a look at WS by people like @baz417 to see what to put.

    You did know (were told in writing) that you had to do a WS. The hearing Order tells you.

    Do it now.  Do not give up. Do a WS. 
    And turn up for the hearing in good time.

    Do not put another foot wrong. Do sort out your mistake, sharpish.  Don't ask whether you can get away without one, or "isn't it too late?" No. Not unless your hearing is Monday.

  • NB - I did write, appeal and say I hadn't received the original notice and asked for the timeframes in which I was supposed to have transgressed, but was given no reply.

    Save it for your Witness Statement (add a copy of your letter to them as Evidence).

  • Those PoC should get this thrown out by asking the judge to read CEL v Chan if you put it at the beginning of your late WS.
