DSG RETAIL CURRYS

I’m angry because I’m being scammed and continue to be scammed by DSG Currys.

I bought and insured a fridge years ago. I opted to pay monthly. I was told whatever happened right down to accidental damage I would get a replacement fridge.

The insurance policy has always covered me up until last year. DSG sent a Meile engineer to our house who said “it’s a write off I’ll organise an uplift” .. my wife is dying from cancer so I am caring for her so don’t shout “you should have called them more” because honestly the right person to talk to about this doesn’t exist and I need help and justice.

My broken fridge is still there. DSG say they ended the agreement with Meile and Meile have to take it. The agreement ended a week after the engineer called. Meile say DSG should uplift the fridge. I don’t know what to do.

I contacted the ombudsman who says it’s not an insurance policy. I can see Currys no longer call it insurance but they did when I signed the agreement. I don’t have the agreement but I do have bank statements with DSG taking money from my account every month (even last month 12 MONTHS after they said the fridge was a right off).

If I cancel they will claim I am no longer insured and I will have paid out more of the value of the fridge for nothing.

What are my options? We were left without a fridge last Christmas and it caused significant problems. 

I’m not likely to be able to take any significant action at the moment because my wife is about to die.

After she dies, should I take them to small claims court to claim back all the money I’ve paid them for a policy that refuses to pay out? (they actually said they would replace the fridge but I can’t get anyone to actually do it).

I tried to access the original wording of the Policy using Wayback Machine and while I can’t access the policy from the time I took mine out it’s clear from the website a couple of years later that they sold me INSURANCE which covered any eventuality which was either called “Whatever Happens” or merged into that scheme later.

Does anyone know how I can unravel this. My wife says just cancel it and thinks I’m an idiot for taking out the policy or continuing it so I remain insured and can make a claim (HOW?) and she wants the fridge gone before she dies and keeps going on about it so I need to do something. 

The agreement started in 2009 so I’ve laid out about £1000 in insurance so far but the number of letters I’ve written to DSG and Currys and the time I’ve spent outlining the case with the Ombudsman etc is far more annoying.

It’s a matter or principle for me now and Currys don’t have any so I need a win. 

Can anyone help?

Especially with finding the wording from the original policy? That would be very useful

    With D&G, I appreciate a different unrelated entity, they sell both insurance and service plans... as much as possible they structure as service plans but some things fall into the insurance bucket. 

    Currys is not an insurance company and never has been, unlike D&G. They do sell insurance policies on mobile phones and tables but the insurer on those policies (today at least) is Aviva. To the best of my knowledge on white goods it has always been a care/repair plan and never formally insurance. Naturally lots of people are loose with their language and call things insurance that aren't but there are wide ranging legal consequences depending on which side of the line something falls from taxation to capital to access to the Financial Ombudsman. 

    When did you buy the fridge? Presumably it is a Miele fridge?

    Have you asked Currys for a copy of the terms?

    So sorry about your wife cancer is horrible and so indiscriminate. 

    Before you do anything you need to find out if it was an insurance policy or a retailer guarantee. They are very different in the eyes of the FCA and ombudsman.

    If the company is still taking money out then they should be able to find a copy of the documents for you. 

    Once you have the documents it will be easier to find out what the next steps are. 

    Have you made an official complaint to Currys and DSG? You will need to if you want the ombudsman to get involved as you will need a full and final response before they can help.
