    I received a "Notice of Allocation to the Small Claims Track (Hearing)" dated 10th June 2024. I don't have a hearing date yet and have no idea how long it could be before I have one, but do you think it is best to start preparing my Witness Statement and gathering evidence at this stage? Or should I hold off on the assumption that it will not actually reach a hearing?

    Yes. But are you sure there are no dates in that Order?  Deadline for WS and evidence?

    The letter describes the procedures and requirement for the Witness Statement, but there are no dates.

    It says "The hearing of the claim will take place on a date to be fixed by the court." and "The claim will be heard at on a date and at a time which will be sent to you later."

    I have received a Notice of Trial Date, dated 25th October 2024, informing me that the trial will take place at 10:00 AM on 24th December 2024 (Christmas Eve!) at the Gee Street Courthouse, 29-41 Gee Street, London EC1V 3RE (Clerkenwell and Shoreditch County Court, not Bromley County Court anymore).

    It goes on to say that unless the claimant does by 4.00pm on the 3 December 2024 pay to the court the trial fee of £27.00 or file a properly completed application for help with fees, then the claim will be struck out with effect from 3 December 2024.

    All this time, I have, of course, been receiving calls from DCB Legal asking to settle. But more often than not, they call me and then immediately put me on hold, so I just hang up.

    I suppose I should get all my evidence together so that I can file it by 14 days before the hearing date, while still hoping DCB discontinue.

    Correct, all standard stuff, so get on with your Witness Statement+ Exhibits bundle, in case they pay the fee and submit their bundle to all parties 

    No phone calls

    I dunno. I'd answer and have a bit of fun with the moneygrabbing aggressors.  Have a little chat and tell them to 'go swivel on a sharp stick' and hurry up and discontinue.

    Just minutes ago, I received the notice of discontinuance by email from DCB Legal.

    ////////////////////////////////////////////////////////////////////////////////////////////////////
    We act for the Claimant in the above matter.  

    Our client has instructed us to discontinue Court proceedings and close our file. Therefore, please find enclosed the Claimant’s N279 Notice of Discontinuance for your records.  

    The attached has also been filed with the Court. 

    We will now proceed to close our file accordingly.
