HELP ASAP PLS! County Court Claim - Highview Parking PCN - VC5 not updated - no chance to appeal

    Hello all, the case has now been assigned to a Hearing via telephone. I understand that a telephone hearing is not the best thing, but not sure there is anything we can do here.  

    My partner is not in the country so I have requested that it be moved to a date when he is as the connection where he is is not reliable. 

    Highview // DCB Legal have written an email offering to setting out of court, which we have ignored. Does it therefore seem positive that they may still throw the case out before the hearing?

    We write in relation to the above matter.  

     

    WITHOUT PREJUDICE

     

    Our client is prepared to make an offer to potentially conclude this matter. We ask that you call us on 0203 838 7038 to discuss this further.

    In response to providing evidence, is there a template for this? We don't actually have any evidence apart from my partners statement  saying that he left the carpark and came back in, which is already in the defense. Not sure what to do here. Any advice welcome.

    Nothing to do until 2 or 3 weeks time (deadline for the WS & evidence which is obviously fully covered - with examples - in the Newbies Thread!) and by then I hope to see you coming to tell us DCB have discontinued.

    I predict next week for the Discontinuance.

    Keep going through the process and it is highly likely they will discontinue before any hearing.

    A telephone hearing suits you if your partner is not in the country on that date. I think you will either have to make provision for access to a phone or contact the court and explain the circumstances.

    So, I don't need to submit a separate evidence statements as in bullet 4 of the letter? The defense statement already submitted is adequate? I hope to update with a discontinuation too!!

    SO sorry - i completely misread. Have just read the newbies thread. Will wait a while before writing these out in hope that they will discontinue. Thanks again.

    What is your deadline for submission of witness statement and evidence?  Don't miss it and don't leave it until the last minute to start the WS.

    Another case for @Umkomaas to add to the disco thread.

    What a complete WASTE of Judges' time DCB Legal are looking to be, on this evidence we continue to gather.  I hope the CJC and MoJ wake up to this model and ban or price roboclaim firms out of parking small claims.
