Online mobile phone company

I paid for two refurbished iPhone 8s on 22nd Sept to Smart Cellular.

I was quote 4 days turnaround.

On three occasions, I chased the order status and was told I would receive the phones by the end of the week and on 9th October after receiving nothing, I demanded a refund.

The one email address they have is never replied to, and the one telephone number rings out only to be told that nobody is available to take the call and then the line goes dead. After delving through positive company feedback (which the company themselves put on) I have seen that I’ve been conned. There was no chance of me ever receiving the phones.

After threatening them with legal action I have finally received an email asking for my bank account number and sort code in order for the refund to be processed. Can they not just refund to the card that was originally used for the purchase? I’m dubious about this company having my banking details and my address (from the order) and full name.

Can someone help me, I need the money back. I also need to report this company.

    Was that card a debit card or a credit card?
    You may be able to request chargeback or, if a credit card, S75 claim.  In this case, chargeback is probably sufficient.

    Why, what do you think they can do with your account number and sort code other than send you money? Your card details would be more useful for any fraud, and they've (presumably) already got those.

    You're not the only one having issues with them - good luck in receiving your money back but as @Grumpy_chap suggests I'd be involving your card provider sharp-ish

  • Today I won my small claims against this company. Long haul. Dud phone that died within weeks. Tried to say you couldn’t carry a water resistant phone in your pocket on a rainy day. Called me a liar and said I’d immersed it in water.  Lots of efforts with emails and at mediation but got my court fees back my money returned cost of repair to phone…plus interest on the amount backdated. Nameless individual for SC tried 48hours before trial to pay money back but I refused as the out of pocket fees they wouldn’t pay. I was confident that they had abused 2015 Consumer act. I was confident truth would win.
    2015 Consumer Act got from MSE👏👏👏
    goods must be as described fit for purpose and durable. If faulty a warranty is not an excuse they must replace or repair. Dig further and there is no 100 point check, no records of where phones have come from, a rapid change over of staff who know nothing about care,  service, honesty, or the law.
    the more of us who actually take it further the better. Keep notes store emails. Read your rights. Take it to the courts. The law is on your side and you’ll win if you speak truthfully and are well prepared Happy to help.
