Been Scammed, Need your help . . . ebay/paypal

i bought a new xbox 360 core but never recieved it also about another 10/15 people who bought something from them didnt get theirs too. basically the seller scammed us, no communication and no items delievered. The scammin n*b got paid by me on the 10th of december by instant paypal, i had to pay first then i would win the item. So i paid instantly by paypal. My paypal had £140 balance which was from a buyer who bought something off me so theres was no need to pay by card via paypal. i filed a paypal dispute on the 19th/20th. He is no longer registered on ebay, as he/she had about 10 negative feedbacks all from buyers and his feedback score went from 23 to 13 and 69.7%. Also on the listing it says "Choose PayPal for up to £150 buyer protection". All i want to know is will i get my full £135 back and also Is there anything else i should do, like file an ebay dispute or anything else apart from the paypal dispute that i have already started. Currently my paypal says "Awaiting other party's response" and "A claim has been issued against this transaction. The seller's deadline for responding to this claim is 29 Dec. 2007. If the seller does not respond by the deadline, the claim will be decided in your favour. You may cancel this case at any time by clicking "Cancel" below." if that helps with my query, thank you for taking your time out and if you can i would be grateful if you can help me as im not very happy, i dont work as i have been ill for a long time and have very little money :mad: and just want this sorted out. cheers

    thank you have read youre thread, i hope your issue gets sorted out, also its the 23rd today hope all goes well with paypal and goes in your favour. :)

    the thing with me is i have never been in this situation before, also i had the money as a balance and not via card, also hes banned now from ebay and his feedbacks percentage and score has gone down, and also i may have heard ages ago paypal dont give full money out. Both of ours are real similar but, its best to have someone proper evaluate my situation. thanks

    I know this suggestion is bit late but it may help in future.
    If I ever have any money in my paypal account I always transfer it to my bank account and wait 24 hours before paying for an item. That way I pay for the item with my credit card and if the need should arise (say if I were unable to get my money back through a paypal dispute), I could do a chargeback from the credit card company.

    dont know much about credit cards never had one, got a debit card. Isnt there a better chance of me getting my money back though, as i used the money in my paypal (balance) to pay with paypal. thanks

    I would suggest is to wait til 29th to see if paypal manage to refund your money as they may have frozen his/her account with money in it. If you don't get any money back from paypal then the other option would be to sue the seller in the small claims court but that's if you have their name and address.

    If you go to the Paypal site click on Help and search for User Agreement, there is lots to read

    As to whether this will help you is another matter but it might only protect you up to what Paypal can recover from the seller.

    Para 13 onwards looks a good read

    I purchased something a few months ago, it never arrived. Seller was still a user and kept promising it'd be sent. Never arrived, opened paypal dispute - seller replied, to the dispute saying she'd refund me etc etc - the deadline came and Paypal refunded me the full amount, I had paid for the item directly from paypal NOT credit card.

    Was £130. Got the full amount back.

    There is hope!

    I hope the OP gets his full amout back but this is different in that his seller is no longer registered on ebay. So it might depend if the money comes from Paypal's own coffers or money reclaimed back from sellers account.

    But what im thinking is that doesnt paypal have limits on how much you can transfer into your bank account?. That seller im sure he couldnt transfer over £1000-£2000 worth within one week and then run off or could he ?, they did also buy about 200/300 pounds worth of goods around the same time. Im thinking there may have been some funds left because of the limitation reason, and as i did my dispute dot on after 10 days 12.00 midnight, wont there be a greater chance for me to get my money then rest or doesnt it matter, Paypal do have transfer limits dont they ? not sure as havent used ebay in a good while. Why do bad things happen to good people lol. i wouldnt care about the money if i was working but im ill, what hurts me even more is the principle, especially at this time of the year how people can steal from others and that also being from a person who has very little money and isnt able to work. shame on you.
