Sainsburys Horsham ECP NTK

Hello,

Elderly couple received the NTK below. They have a disabled badge.
They were using the car park at Sainsbury's. They asked the security guard if they had to pay and the guard said that they did not have to do anything as they had 2 hours free because of the disabled badge. Obviously, that was the wrong advice. The (elderly) keeper received the NTK from ECP. I went back to Sainsbury (it is far for me) to try to get them to cancel. There was a car park marshall who, after discussing with his supervisor, said that the guard had given wrong advice that we should not listen to them, and that I would have to pay it as there was nothing he could do. 

So now, I come to ask for your help. It cannot be ignored because of the threatening letters they'll keep sending the NTK and they don't want that that kind of stress. I need to send an appeal today to ECP for the 14 discount to stay. 








Is it PoFA compliant? any advice please?

    So you spoke to a parking attendant and you spoke to a security guard.

    What about speaking to the Sainsburys Customer Services or even the Sainsburys Manager?

    Unfortunately I did not :/ I realised I should have done that.

    No. The parking is in town and they needed to go to Duneim opposite. So they used Sainsbury parking to go there. 
  • As a Horsham local the Sainsbury's parking situation has apparently very recently changed to being a free stay car park for 2 hours even if you don't shop in the store now  (need to confirm as was from Facebook).  There have been no shortage of complaints on Horsham Facebook groups (coupled with bad advice from uninformed members of the public) of this car park.  I've always wondered what the planning stipulations for that car park were, as it is very close to the town centre and many other retail outlets.

    You may be right. This article literally published today says there's plenty of confusion.

    What do you think of this appeal to ECP?

    PCN NUMBER XXXX

     

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

     

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

     

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

     

    The driver of this vehicle is a disabled badge holder and was advised by the staff that there is 2 hours free parking for the driver and that nothing was needed to be done to validate the parking. Due to this, the driver left without doing anything as advised.

    Dear Simon Roberts,

    I am writing to make a complaint about your parking arrangements and unnecessary stress given by your staff and by the company that manages your parking.

    A driver who has visited your store had asked your staff regarding the process of validating the parking for the vehicle. The driver is a disabled badge holder and is of elderly age. The staff had advised him that the parking is free for 2 hours and therefore does not require to do anything. So the driver left without doing anything as advised. However, some days later, the Keeper of the vehicle received a PCN NTK from Euro Car Parks asking for a payment of £85 which is absolutely ridiculous! This has given unnecessary stress to the driver who feels disrespected and violated to have a member of your staff advise him incorrectly and then being threatened to pay absurd amount of money.

    Hi.

    Apologies for gatecrashing, but I received a NTK when parking on 07/10/23. I only saw the 2.5hrs free for customers.

    I did not notice that I had to validate.

    I realise this is different as I am not disabled, but is there any way of appealing this?
