Pre-reg car query

  • Thanks to all.  Confirms what I suspected.  Dealer is now in big trouble - will report back!
  • I wonder if it's been pre-registered outside the UK...

Channel Islands? Lots of ex-rental CI cars come in to the UK at about 6mo.

If it's been registered with the intent of being rental, but then never issued to a rental fleet or actually used for whatever reason, then that might well explain a delivery-mileage 6mo car being imported from Jersey or Guernsey to the UK.

CoC would be needed to UK register it.

    Won't make any difference.
If you can't have the car, you can't have the car.

But be nice if they were honest with the delivery date.

It will because I will buy another pre-reg of same type - they are available but more expensive now than 6 months ago.  I will claim difference from dealer - I have given him a week to deliver the car before I buy another.

Why would they agree to pay the difference?

And most likely get the same delay & excuses. The small anecdotal sample on here indicates that.

A salesman will tell you anything to get the sale.

You want one that you can drive away the same day, preferably you transfer the payment whilst sitting in it on the forecourt pointing at the road with nothing in front of it and you are holding the keys.

They contracted to sell a pre-reg car.   They either did not own it or it is was not registered when they agreed to sell it.  Implied term that delivery in reasonable period (in the absence of anything specific said about delivery).  So they are in breach of agreement on any number of counts and liable for loss suffered:  for breach of contract this includes loss of bargain which is the term for the loss I am describing (i.e. will cost me more now to buy the same).

There's a whole load of assumptions in here that are likely to leave you disappointed.

You've still not said who the dealer was (and if you don't want to reveal a name then at least whether it's an official Toyota dealer) and what, if anything, you've done to escalate this via either dealership network or Toyota.

As suggested elsewhere the words used make it sound very much like an import unless it's a brand new model that's been delayed for everyone.

Probably the most important thing is how did you pay your deposit and have they returned this to you ?

Signed any paperwork? Read the T/C?

Many contracts are not formed till you actually take possession.

Also note that will be you breaking the contract, by cancelling & going elsewhere.

My last 3 cars have been pre reg and all have been see it, pay for it and drive it away.  None of this messing around waiting - well, the last one took a couple of weeks for it to come from the head office compound before I saw it but nothing signed until then.  It looks like they have got a car from the manufacturer cheaply as a demo and can't contractually sell it until x months have passed, the ones they previously would have sold without transferring ownership.
