    Which is why I said:
    They aren't going to cancel it and you won't win at appeal, and they don't do court!
    My advice was given for a reason.  

    and this was what I advised:

    tell them to either let you appeal as keeper, or go straight to court if they think they have a case, and not add the fake £70 that the Government is set to ban because you will not be paying a debt crawler:
    Does this mean I should just respond and ask them to find the driver as I'm not liable? in order words, go fish.

    Thanks all for your input. To close off the post, the ticket has now been cancelled.

    In my initial appeal, I used the blue wording from the Newbies thread but added some further wording at the end, effectively giving them a 14 day notice to respond with all data/information requested (I'm not suggesting here that others should do the same).

    I then replied to their letter I posted here telling them that as they have confirmed that only the driver can be charged, they should go find the driver and stop harassing me as owner. Furthermore, they had by this point gone over the 14 day period and so their invoice is no longer valid.

    They replied stating that the ticket is now cancelled... To confirm - the response was by APCOA as opposed to Gemini.

    Maybe I was just lucky.

  • @RedCuppa This is helpful - I'm in a similar situation. How did you send the reply to their letter, by email to Gemini, online in some other way or by post to the APCOA address in the letter?

  • To report back. I did originally appeal online following the advice on the Newbies advice,without identifying the driver and also attaching evidence of payment (redacted bank statement), although parking ticket had not been lost by the time the PCN came through.

    I received the same wording reply to this appeal as RedCuppa received in this post, with direction to respond by post.

    I replied via email in a similar vein to RedCuppa, again declining to name driver or keeper at the time, and that they were required to accept appeal by registered keeper, cancel PCN or take to court, where I would claim for loss of earnings.

    They have now responded to cancel the PCN, so good news.
