Stansted McDonalds Starbucks Southgate County Court Claim

Hi Everyone, The keeper has received a county court claim form from the infamous Southgate car park at the McDonalds/Starbucks in Stansted. This is with DCB Legal and Met Parking Services Ltd.

The PCN is dated from 2018 and over 5 years ago. The county court claim form issue date is 18 September 2023.

An Acknowledgment of Service has been filed.

Is there a benefit in issuing an SAR at this stage?

The first draft of the defence is being drafted and hope to know if there are any pointers and tips. The first draft will be posted below when complete. Thank you so much!

    Is there a benefit in issuing an SAR at this stage?
    No, because the DCB Legal Particulars of Claim (on your claim form) are so woefully inadequate (and what you'll be defending against), you don't want to indicate you have any greater knowledge of what the charge from 5 years ago is about. 

    Look up the persuasive Judgment by HHJ Murch in Civil Enforcement Ltd v Chan. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Don't do a SAR.  

    Do a defence like the one by @Rorythoperr

  • As said above.   We know that DCBL take on the most rubbish claims,  but this car park is just a complete scam.  OPERATED by MET PARKING ....

    This is prime rubbish for DCBL to be spanked in court

    The county court claim form issue date is 18 September 2023.

    An Acknowledgment of Service has been filed.

    Please confirm the date you filed an Acknowledgment of Service. Your MCOL Claim History will have the definitive answer.

    With a Claim Issue Date of 18th September, and if you filed an Acknowledgment of Service sometime after 22nd September and before last Monday 9th October, you have until 4pm on Monday 23rd October 2023 to file your Defence.

    That's less than two weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Is it wise to include HHJ Murch in Civil Enforcement Ltd v Chan   as part of the defense?

    Watching the youtube video - a scam if the correct definition! it is frustrating we have to go through this process on a scam. I am hoping the Judge/Court will be well aware of this.

    As it is a DCB Legal issued claim, absolutely, positively 100%, you must include CEL v Chan as a preliminary matter in your defence.

    The Template Defence already tells you to use it.  I edited the Template days ago, to add it.  There is NO QUESTION.  Use it!

    It's a scam and a money trap.
    Then DCBL ADD their own fake scam PLUS £70, CALL IT DAMAGES, YASMIN MIA says it all true by signing a statement of truth ???? 

    And then The Template Defence ....

    What is there for a Judge not to like ?

    DCBL know it's all rubbish and they will discontinue or enjoy a court spanking when you can claim your costs
