I have received a QDR Solicitors letter for someone else at my address

Hello all,

I have read through the Newbies section to familiarise myself with the PCN processes, however I didn't see anything that advised on this.

I have received a letter from QDR Solicitors at my address but it's addressed to an old occupant that has not lived here since 2021. I opened it by accident.

The letter is the standard one which says QDR are acting on behalf of ZZPS and Euro Car Parks, with the 14 days notice and they may pass the matter to their Litigation department.

My question is, what do I do with it?

Should I contact QDR or Euro Car Parks to inform them this person no longer lives here? They obviously don't have the correct details for them.

I don't want to cause the person its addressed to any additional aggravation so want to do what's best for them. I will try to see if I can get in contact with them as it might be possible. They maybe totally unaware of this.

    Put it back in the envelope tape it up and send it back "Not known at this address return to sender" just like you would any other post.

    1. In writing. A simple 'not at this address, moved out xx/xx/xxxx, do not have a forwarding address'. 

    2. While they might not welcome being informed/reminded of this, the parking firm/solicitor having and using an old address seriously puts them in danger of a default CCJ, with a devastating impact on their creditworthiness for the following 6 years - and a real costly mess to sort out later. If you are able to contact them, advise them to please not ignore this, it can become really nasty, but to make contact with us on the forum and we will guide them through.

    EDIT TO ADD - If you can make contact quickly with the former occupier, do that before firing your letter off to QDR, because once they know the person isn't at your address any longer, they might well fire off a quick court claim for a guaranteed judgment in default.

    Thanks for the response.

    I've managed to get the phone number of the former occupier and we have messaged.

    It turns out they have now sold the car that the PCN is associated with so will no longer be the owner on the V5C document. They also said that they don't think they updated the V5C when they moved from here in 2021 so that will explain why these companies have the wrong address.

    So based on your comments, I should now do nothing and not contact QDR?

    Any advice for the former occupier, should they contact Euro Car Parks or QDR to give them their new details? Will Euro Car Parks have to start the process again and issue a new PCN with the original fine?

    Yes, get them to write to the both parties giving the new address and require them to erase (use that word) and replace with new one. Tell ECP to inform any other of their agents handling the person's data to adjust their records.  

    I'd hold off on you writing for now - if you receive any more letters, either the person hasn't followed your advice, or QDR are ignoring it. Keep us informed if anything further comes through your letterbox.

    As an aside - the disposal of the vehicle has no bearing on the case. Potential liability lies with the driver or possibly the registered keeper at the time of the parking event.

    When you say get them to write to both parties, do you mean a physical letter (registered delivery presumably) or is email sufficient?

    You clearly send the motorist the letter (sharpish) and direct them here so they don't do something stupid like paying the scam.

    They need that letter. Tell them to come to this thread and that no-one pays QDR.

  • "Dropping" a letter to them is not likely to be worth the paper it is written on unless you can evidence it being received and accepted. By sending it with "proof of posting" certificate, you can evidence that it was sent. By sending as an attachment to an email, you can prove it was sent.

    I don't think it matters. Nothing this OP needs to worry about.

    The real intended recipient just needs the letter handed to them, so they can update their address data and respond if it gets to LBC stage.

    I am the motorist that the PCN relates to so I’ve joined here as advised.

    I now have the letter from QDR Solicitors, this is the first letter I have seen on this matter, so have only just become aware of it.

    I did not update the V5C document when I moved, so that’s why all previous letters were sent to my old address. My fault I know and having read the details in this forum it looks like that is no defence and is on me.

    So next step I should email both Euro Car Parks and QDR informing them of my new address and asking them to erase my old address and replace with new one. Also inform ECP to inform all of their agents of these new details.
