Think we will see lots of questions being raised, where HMRC have been paying wrong amount of Tax Credits and UC are not going to pay benefits based on any error.

In this situation it may be wise for people not to raise questions with HMRC about how the Tax Credits were previously calculated. They may realise the mistakes made and calculate overpayments. Seek advice first before making situation worse.
The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

@huckster - how can we seek advice when after contacting Citizens Advice they have told me they are not allowed to help me with the UC calculation and transitional payment (written in my first UC payment by UC).
Edit: to say lack of transitional payment and resulting in a £105 minimum deficit each month.

Its really tough when Cit A say they won't advise but i can see why they are saying that due to all of the uncertainties around TP. The only way to move forward in your case and ask DWP for the transitional protection calculation and perhaps post it here to get some help or try another organisation. And lodge a protective mandatory consideration.

I think Huckster was referring more to posters in the OP's position where it appears there may be something wrong with the underlying tax credit award that may only come to the surface because of people questioning the different rules in UC. There is no reason why Cit A couldn't help someone look at their tax credit award.

@Icequeen1 - I have written in my journal that I request a mandatory reconsideration and did that on 8th October - I have still not had an acknowledgement on my journal that they have even seen it! I think I must be invisible - it is overwhelming now.

How do you know that someone has seen it? I'm certain there's no way of knowing someone has read it, at least i can't tell from my daughters journal. Tomtom advised on your other thread that there's more chance of someone seeing it at the end of your assessment period.

@poppy12345 -  thank you. Yes I did see Tomtom reply and appreciate it - it is just a mandatory reconsideration must be made within a month and if they do not look til the end of this coming assessment period it will be over a month. I have taken photos of my journal and entries just in case the website goes down/ entries get lost. I mean no disrespect to anyone. Thank you

You actually have 13 months as an absolute deadline. If it's outside the 1 month then you need to give a reason. Them not acknowledging the MR request is a good enough reason.
  • For a payment from UC i don't think it matters whether it goes in as unearned or earned pot. The only thing it will make a difference is for free school meals and free prescriptions. As im sure i read somewhere that its only earned income that taken into account when working out free school meals. If that's the case it would be better for us for it to go as unearned income, along with ESA and carers. Please let me know if I have this incorrect. thanks

Unearned income reduces UC pound for pound.  Earned income reduces it by the 55 p per pound taper rate
