Now received reminder from CST

Hi all

I have been reading the newbies thread for a few hours but just keep getting lost in the links. its answered many of the questions but I have a few more I have not been able to draw from the already written information. Using the FAQ's and other threads I have tried to include the relevant information regarding to my issue in the thread.

I do not currently live at the address my vehicle was registered to so there has been a big delay ion the letters arriving at the property and me actually being aware of them.

May 2023 my vehicle was parked for 9 minutes 31 seconds in a UKPC carpark during a nightime restricted no parking period

May 2023 I was sent a Parking charge from UK Parking control ltd inviting the registered keeper to pay the £100 fine

June 2023 I was sent a letter from DRP telling me "the time has come to decide how i wish to proceed payment with the creditor being UK Parking Control

September 2023 I am sent a letter from CST Law stating "Unpaid Debt - Reminder Notice" advising they have been instructed by DRP stating they I need to pay £175 or they may take me to court however they want to resolve amicably first

As I Mentioned i am no longer at the property and the tenant forwards mail on to my new address currently until the property sells, so there has been delays in my seeing these mails.

Am I to wait or is there an appeals process for this?

Thankyou

    It is not a fine.

You must send a rectification notice to the DPO of UKPC telling them to erase your old data and replace it with your current address for service, and to instruct their agents to do the same. Make sure you use the word I have highlighted.

Ignore the letters from DRP and CST. Debt collectors are powerless and can safely be ignored. They will not have said they may take you to court because they cannot. Only UKPC can take you to court. Do not ignore a letter of/before claim.

Plan A is always a complaint to the landowner and the keeper's MP. Did you do that?

Plan B is to appeal. Did you do that? You are too late to appeal now.

Where did the alleged event occur? It may have cropped up here before.

    1. Two threads to read:

    2. You need to write to the DPO of UKPC, telling them to erase your former address and replace with your new one. Tell them to inform any of their agents handling your data to do likewise.

    3. Debt collector letter - as per 1 above

    4. Wait. Other than a landowner complaint, no 'appeal' open to you at this late stage.

Plan A is always a complaint to the landowner and the keeper's MP. Did you do that? No I don't know who the landowner is as they are referred to as the client

Plan B is to appeal. Did you do that? -You are too late to appeal now. -  no. Only recently seen the letters

Where did the alleged event occur? It may have cropped up here before. -  Hedge end Trade park, the sign at the entrance to the KFC Carpark states the carpark is locked overnight but there is no barrier and the sign cant be seen in the dark!

It the past JLL have been good at getting these things cancelled.

If you live nearby, get photos of the site and signage and/or use Google Streetview images if it's too far for you to travel there. UKPC signs are always inadequate and fail to meet the BPA's CoP. The wording and positioning, or lack thereof may also be of use.
