Concerning 6 PCNS
Claim was on the basis of keeper liability
Defendant had emailed driver details which the claimant stated they never received.
Email produced in evidence
Thought they would discontinue but went to a hearing. No rep turned up. So think may well have been an admin error or such like..
Durham is such a tiny court , nice and easy not many cases listed. Judge heard the case in their absence and stated keeper liability was not proven
case dismissed, didn't entertain unreasonable conduct argument
£65 costs awarded and enough time to look round the shops and spot of lunch. Some lovely buildings in this part of Durham
