Amazon have refunded me for something I did not return.

I this case, probably. I've experienced both third party and Amazon sold items and they were equally generous with their own monies. Had ordered a pot and its lid which was an optional extra, the lid arrived and it was fine so threw the packaging and the tracking said the pot was delivered never did, only spotted it was marked as delivered a few weeks later. At this time the AWOL piece was no longer available from Amazon EU (where the original was coming from) and was 10x the price almost to get it from the only other seller which were in the US.
Mention of a 3rd party seller could suggest Amazon has been generous with someone else's money in this instance.DullGreyGuy said:

Because it was the 3rd party sellers mistake apparently I get to keep the item and the refund which has been confirmed in an email by Amazon.
Amazon refunded both items and said to keep the first one (not that a lid to a pot is that useful on its own)0
