Strange email from Gladstones after notifying them of SAR request and 30 day suspension

Hi,

I have a PCN with UKCPM and followed up by Gladstones. I sent a SAR request to the car park and sent the recommended template email to Gladstones asking for 30 days and asking them to clarify the extra £70 added. This was early June 2023. Original PCN is from July 2022.

In the past this has been enough to never hear from them again. I haven’t provided proof of ownership to receive the SAR request info as this has made them ‘go away’ in the past.

Today, after a few months after sending the email to Gladstones I was a little surprised to receive the attached email.

How should I proceed - should I reply, or just ignore and prepare for court?

Is it just hot air/a last ditch effort go get money out of me as they know they’ll fail in court?

I tried searching but couldn’t find anything on the solicitor replying to the email.

Thanks
Good morning

Thank you for your email, the content of which is noted.

The case against you has been on hold, for considerably longer, than the 30 days you requested.

To date we have not received payment of the balance owed to our client, or indeed a proposal of payment, from a debt advisory company?

Our Client is therefore satisfied the case against you should proceed unless the debt owing of £170.00 is discharged in full.

To ensure no further action is taken, you should make payment no later than 30 days from the date of this correspondence.

In the event we do not receive payment within the time scale specified, our Client reserves all its rights including the right to commence Court proceedings, without further reference to you.

You can make payment using the following methods:

Online

Visit www.gladstonessolicitors.co.uk

Over the Phone

Call 0333 0230 049

Via Bank Transfer

Name: <Gladstones bank details>

You must include your reference XXXXX when making payment. If you fail to do so, we may be unable to allocate your payment. This may result in further costs being incurred, for which you will be liable.

Kind regards

They have basically put it on a 30 day hiold.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • My original email to them from 02/06/2023. I have not received any correspondence by post.

Sounds like it’s going to court then. I better follow up on that SAR.

Should I reply? If so, should I mention that they declined to clarify re: extra £70?

Forget querying the extra £70 with them.

You don't want anything clarified.  You want a badly pleaded claim!  Have you missed the HHJ Murch judgment now used in defences?

    No links.  Easy keyword search!

Thank you - I’ll have to look on my computer as lots of references to HHJ Murch from yourself but no actual info on what it is. Will be easier on a larger screen.

Unsure why original image has been removed? I removed personal information. Apologies if I missed something?
  • I'm seeing many references to HHJ Murch judgement but nothing clear - just lots of references to it but not actually an explanation of what it is or how to use it in a response.

If anybody in the know could save me a few hours, that would be fantastic.

    Thanks

When you eventually get a claim, you will be copying a defence that references it.   But you aren't even at that stage yet.

It's on every thread writing a defence today, including the one this afternoon by @PCNagro and dozens more.

Will do, thanks. Seems like a lot of reading to do. Do you think there's any way to avoid getting to the claim stage?

    No.

And there is not much work involved at all.  We've done it all for Defendants. We win.
