Pay fine or go to court

Dear Sir,

On the 21st December 2022 I received a parking charge notice from Ipark Services CA113BA.
Stating that I had parked in a car park 12th December 2022, Showing my vehicle entering the car park at 14:47.
This car park has always been a community car park where people park there free of charge.
Having noticed the signs once in the car park stating that I had to pay by credit card only as they did not take cash.
I decided to leave the car park as I didnt have my card on me.
I was approximately in the car park for 5 minutes then I exited
The parking notice only shows times on me entering the car park, not the time I left, I have requested this from them.
I have made numerous phone calls to this company only to get cut off, It seems that they only answer the phone when you want to pay a fine.
I have sent them emails requesting to contest the parking charge as I was only there for max 5 mins.
I have received 5 further letters telling me to pay
As this has been going on for nearly a year they have now decided to take the matter further and have put it in the hands of a debt collecting company DCBL Legal.
The cost of which now is £160.00 due to non payment.
I have responded by phone every time I receive a letter telling them that I contest the fine due to the time I was in the car park.
Their next threatening letter is to send me a letter of claim to take me to court.
I will not pay the fine as they must have to give you a certain amount of time to exit the car park if you do not park there.
Their notice on the outside of the car park just says car park not pay and display.
I have taken photos of the terms and conditions sign which can only be read once you are in the car park, You cannot read it from the side of the road.
I have requested both in and out times of the car park from them but no answer.
I see their tactics as intimidation, sending you threatening letters, taking you to court and giving you a CCJ all because I was in their car park for 5 mins.

I just need some advice on whether I have a good enough case to take it to court and win.

Thanks

You do, as long as you get it out of your head that it is in any way a "fine". Which car park? Have you actually received LoC from DCB Legal?

As advised above, if you have received an LoC, you also need to read the second post of the Newbies/FAQ thread.

Just read the second post of the NEWBIES thread and don't send responses that talk about fines.

    You don't have a fine.

    You don't pay it.

You defend a court claim using our advice.

    You then win.
