Delayed Flight

Can anyone confirm if I am entitled to compensation for a flight delayed by 19 hours if I chose not to take the replacement flight? I have had a compensation claim denied on these grounds Thanks

     More details? Why did you refuse the replacement? How long would the delay have been if you took the replacement?

    Was the flight delayed, or cancelled and then replaced with one with a different flight number?
  • The flight took off from Gatwick but returned as the pilot was not happy with a vibration in an engine. This was a 6.30 pm flight to Prague for a long weekend. The first flight they offered us was 1pm the next day. They did offer a hotel but that's not the issue. So the delay was 19 hours. We spoke to the ops manager for the airline at Gatwick and said what if we don't go as it had eaten in to a short break. He said it wouldn't affect refund or compensation so we went with that. We have received a full refund without any query but the compensation was denied as we didn't take the flight the next day. We rang customer services but they stood by their decision. I'm not sure if it was a different flight number but I believe it was laid on specifically as a replacement.

    It's an important distinction - if the first flight was cancelled and you were offered a replacement then you'd be due cancellation compensation, but if the later flight was regarded as a delayed departure but for the original flight number then you'd need to have been on it to claim delay compensation.

    I looked it up and it is indeed a new flight number. So perhaps I claimed the wrong thing as I went for a delay?

    Yes, a cancellation claim sounds more applicable, entitling you to either a refund or the incremental cost of an alternative flight, plus fixed tariff compensation:
