I am 15 miles from Leicester Apple Store and have used the Genius Bar several time with iPone and Mac. Their service is exceptional, I have not always bought from Apple, sometimes John Lewis but as far as I'm concerned Apple regard an Apple product as Apple no matter where you bought it from.Alderbank said:

I'm not an Apple fanboy but I have taken family members' iphones to the Genius bar and I know other people who have done so.
The quality of service from the 'geniuses' is impressive but my observation is that in every case when they can't fix it on the spot they replace it with a refurbed phone. The OP's concern is that they don't want a refurb.
My experience is limited to Manchester and Edinburgh stores.
And not always less 'faff'.
Only 1 genius bar in the whole of Wales and only 4 in Scotland. So if you are a 90 minute flight or a day on the ferries away then the less faff option is to pop your phone in the post.
Over the years from the first iPhone I have taken 2 back with a problem and on each occasion was presented with a replacement in a sealed box.0 -
Phones that Apple have refurbished (new battery and body/screen) are supplied in a box. It's only the model number that will discern it is refurbished)0

With a product that is less than six months old I find it hard to believe that the consumer would be better advised to take the benefit of a manufacturer's guarantee rather than go back to the original seller.
The OP in this case is surely entitled to a repair or replacement from the seller. And in this case a replacement from the seller will need to be brand new - not refurbished.
And if the repair/replacement fails the OP will be entitled to a refund.
The OP needs to go back to Vodafone Virgin under the Consumer Rights Act 2015 (legislation.gov.uk). It's irrelevant that he's now transferred his contract to O2.1 -
Sadly that is not the experience of other users who have had issues with their I-Phones & been told they need to take them back to the retailer they bought them from.MikeJXE said:

I echo the words of others on here of Apples ‘exceptional’ service. Sometimes it is. Sometimes it isn’t. You have no rights with Apple, so when they give you a ‘free’ phone (a refurb rarely new), it is either through a warranty or through AppleCare. If via AppleCare then yes, even if you bought it elsewhere, the support from AppleCare greatly outweighs your consumer rights and you’d be foolish to not attempt that, but that’s also depends on if you have AppleCare.If the phone is pay monthly, it sounds like the phone isn’t paid outright so it raises other issues if you get a new phone. For example, if in 12 months time you, outside of Apples warranty, have your phone break down and O2 replace it - it’ll raise a red flag that the phones serial number is different than what they were expecting.Also I’ve found Apples got a tendency to offer the world in store and the second it gets to the next layer of repair (the Depot) it get rejected, or scaled back.
Virgin-O2 is the way to go. They also have a clear escalation process in place. Don’t let them fob you off with ‘gesture of goodwill this, and that’.0
