Disability Vehicle

Really sorry but I’ve struggled to understand some of the information provided in your very thorough thread.

my car is leased via a disability allowance and my mother is the registered keeper (she is disabled and I drive her around).

We recently changed the car and I forgot to input my new registration into my gym account and I’ve now received SEVEN PCN’s (one for every day I went to the gym).

How do I appeal this as I am an “allowed” driver and not the registered keeper.

Sorry again.

    Which parking firm?  Excel?

    Mum appeals.

    You don't.

YOU complain to the gym manager.

Get them to cancel them.  You may need to end your gym membership because this is no way to live.  Horrible scam operation.

    “Civil Enforcement”.

I complained to the gym manager who offered to cancel the charges for a £30 admin free (per charge)…

    I told them no.

I will get my mum to appeal and following advice on the thread wont mention the fact I was driving.

Cancel your gym membership then. If the manager won't support genuine customers they don't deserve to stay in business. This is classed as a major keying error, and the BPA state that this should result in a payment of £20 being requested, so the manager is trying to rip you off.
You can help your mum with the appeal, but it must be done in her name. She could add a one liner to the template in blue text from the NEWBIES that she was not driving.

Just to point out you should not be using a motability car for your personal use.   It is only to be used for the benefit of the person it is leased to.

How you cannot use your car

We take misuse of your car very seriously. This means things like:

    • Not using it for the disabled person’s benefit
    • You or someone else driving without insurance or while you’re banned
    • Using it in a criminal act
    • Lending, sub-leasing or selling it
    • Using it for business reasons we haven’t agreed with you, like as a taxi or for deliveries
    • Not taking good care of it

If we find you’re misusing your car, we might terminate your lease, stop you from getting another Scheme vehicle, and send you the bill for any repairs or estimated loss in its sale value.

I thought of that too, but wasn't 100% sure it was a Motability car in this case.  If it is, then it is not a family car; not allowed for general family member 'nipping around' transport at all, as you say.

The OP didn't say it was a Motability car, but that it was leased via a disability allowance. I'm not sure what difference that makes though.

Same thing. The mum probably recieves PIP mobility component.

Of course, it may be that the mum also uses the gym (or that the OP combines trips to the gym with errands for the mum).

Thanks for all your concern guys. I go to the gym before I do the food shop for my Mother and/or drop her to the day centre where I then go and pick her back up to take home.

OK.  Now read the judgment against CEL that was posted this week. Come back if you get a court claim.  No worries.

As a disabled person with a Motobility car, I feel I should correct this post. I have been on the scheme for a number of years and as my health has deteriorated, I am no longer able to drive. My partner does the driving and this is our only car. She uses it to travel to and from work, shopping, seeing friends etc. Because of this clause and other less than informed posts, I have spoken directly on the matter with Motobility.

All bar the first point are obviously forbidden. However, if you live at the same address and are a designated driver, it is reasonable to use the car for personal use in normal ways. The argument in this persons case is that if something happened to his mother, he would need to return asap and it is quicker by car. Where there is confusion is that the Blue Badge cannot be used unless specifically for a disabled person.
