claim form for parking - DCB legal

received a claim form for parking from DCB legal
parked date is 24/08/2022 and the registered keeper is myself but the driver was my spouse. I informed DCB legal in December 2022 through a telephone call that I was not the driver and the person to whom I had spoken (I know the name)  wrote everything on the system as per my request(I believe). He informed me that he had done so and no more letters would be sent but now it reached to money claim. So I want to appear in the court myself and prove it. is it okay for a layman to attend court or do want to refer this case to the parking appeal team which is asking £69 for their involvement? so what should I do? please help me with step-by-step answers if I want to appear in court.

regards
greats

What is the "issue date" on your claim form?

Please read the second post in the Newbies/FAQ thread for guidance.

Who is this "parking appeal team" you speak of?

Forget that. You need to defend yourself against the Court Claim.

    Please answer @B789's question.

With a Claim Issue Date of 13th September, you have until Monday 2nd October to file an Acknowledgment of Service but there is nothing to be gained by delaying it.
To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 16th October 2023 to file your Defence.
That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
  • Thank you so much. I never visited the court so I don't know how the court works?

Which is why our Newbies thread and Template Defence exists.  All the new posters with claim forms are like you.  This is easy.

Hasn't the Defendant read the link to the NEWBIES thread yet and seen that we WIN cases, and how simple it is?

So I want to appear in the court myself and prove it.
You can be a witness (alongside the Defendant if it gets as far as a hearing) but it isn't your claim to defend.

DO NOT DO THIS IN YOUR NAME.  THIS IS NOT YOUR CLAIM.

is it okay for a layman to attend court or do want to refer this case to the parking appeal team which is asking £69 for their involvement?
Who do you mean? Name of firm?
DO NOT PROVIDE A LINK PLEASE, AS WE DON'T WANT OTHER NEWBIES LOOKING AT PAID SERVICES.

You don't pay anyone to do this simple stuff and anyway, the Defendant has to sign the defence.  Not you.

See the post above by @KeithP, where he guided you to the NEWBIE sticky; here you will find a link to the template defence thread where your (well anybodys) defence has almost been written for you. If you adjust your paragraphs 2 & 3 and add any more (without turning it into War & Peace) one of the regulars will offer a critique.
You have to be a bit careful about ParkingEye as they don't (always) add the debt admin fees. In the NEWBIE sticky there are some examples of PE defences.

Yes we will review it and help.

You just write your facts in paragraph 3 using the Template Defence.

Maybe half the Defendants where were registered keeper, not driver, so why not just browse the forum you are on and read other claim threads for inspiration?

No links.  Go read any court claim threads.  Copy and adapt to suit.
