I still wouldnt book a package with them for the simple reason they dont operate their own airline, I would much rather use someone like TUI, Jet2, and at a push Easyjet, where its all wrapped in together with the same company.
I used easy jet holidays back in October last year for a holiday in sep, this year ( first time using them in years). 6 days before my holiday they emailed to say hotel overbooked , they offered me an alternative in a different part of the island , I booked very early to get the hotel I wanted in a specific part of the island so I cancelled for a refund and managed to get a flight with jet2 and a hotel in the resort I wanted all be it not the same hotel….not what you want 6 days before you are due to travel tho
Overbooking can happy with anyone tbf, it wouldnt put me off using any company if they sorted it out in an acceptable fashion.

They didn’t sort it in an acceptable fashion. That’s why I cancelled for a refund 6 days before I was due to travel and 11 months after I booked it.
Not much they could do if the hotle only told them 6 days before that they ( the hotel) had overbooked. It wouldn't be Love Holidays who id the overbooking

if Love Holidays didn't have rooms available in another close hotel they couldn't magic one.

Jet2 had empty rooms in one of their allocated hotels. Love Holidays may not have had a contract with that hotel.
Getting a refund from Love Holidays was a very good result, knowing their reputation.
Maybe you should re read my post.

Regardless that you have read it wrong

do you think it’s acceptable for a tour operator to cancel a long standing booking 6 days before departure.

You said ‘the hotel overbooked’ so it was the hotel at fault.

If they only became aware of the situation 6 days before departure, I don't see what else we could do.

We booked a package with TUI - we wanted a specific accommodation that only dealt with TUI - 9 months before departure.
4-and-a-half months after booking and 4-and-a-half months before departure, they contacted us to say they'd made an amendment to our holiday. Not only was the change a different accommodation, it was in a different resort.
We cancelled and accepted a full refund.
It turned out that the accommodation owners had swapped to JET2.
We manged to book the room we wanted with JET2.

I can't see what TUI could have done differently for us.

  • Just an observation.
"It turned out that the accommodation owners had swapped to JET2."
I always thought that hotels were legally contracted to the major league package holiday firms, such as TUI, to provide X number of rooms at specified dates ?
Of course there may have been a mutually acceptable arrangement between TUI and Jet2 to allow such changes.
The bottom line in this case is that TUI agreed to a full refund - going by previous reports of Love Holidays that would have been doubtful.

I think the contract had been held by TUI for a number of years (we'd stayed there 3 times before with TUI) and they offered the accommodation before the contract was finalised and I guess JET2 offered them better terms.

The accommodation is with JET2 for 2024.

Agreed - and I think that's why this was said:

I agree 100% with that last quote.
Based on experiences in Malta in 2010 during the Icelandic volcano eruption no fly scenario.
We were with Thomas Cook on a full off the self package - they kept us in the same hotel, with same board basis at no extra cost for 4 nights - then chartered  an Air Malta plane to get everybody back to the UK. TUI did a similar thing for their customers.
In comparison, there was a large party of Irish clients in the hotel who had flown with Ryanair as a DIY arrangement.
Had to leave the hotel or pay the extra days until they could organise homeword travel - this resulted in 3 ferry journeys and two separate coach connections costing them around €1000 per head.
That convinced me the TUI and Jet 2 are the best choice to avoid dramas.
  • Well I used Love Holidays and won't be using them again as they advertised a hotel which was being used as a refugee camp/housing facilities. Have complained they have stated that the hotel has the right to host all nationalities and do not discriminate.
However Love Holidays was aware of this prior to my travel as they received complaints, removed one family and everyone else was told nothing they could do. They told me to end the holiday with hotel if possible and find mynown hotel.
Do I have any rights to seek refund? as to me this was a mis-sold holiday in which Love holidays knew there were issues.

A refund on what specific grounds?  As they've correctly said, the nationalities of other guests isn't a reason in itself, so you'd need to identify an actual issue impacting your holiday.

Regarding "They told me to end the holiday with hotel if possible and find my own hotel", were they actually saying that they didn't accept that there was an issue, so if you wanted to move, you'd be responsible for doing so yourself?

I cant see why they would be liable if your room was still available to you.
We were in Texas just after Hurricane Katrina (all self booked in 4 cities) and every hotel was crammed full of migrants from Louisiana (mainly the poorer districts). The hotels all honored our bookings and whilst it was not ideal there was nothing that could be done, and lets face it if you had lost your house and were living a full family in a hotel room you are way worse off than someone who is just inconvenienced a little.
