Fitbit UK and Ireland LTD.

Good afternoon,

  Wondering if anyone can point me in the right direction.

I'm looking to make a claim against Fitbit UK and Ireland LTD based in Dublin. (Republic of Ireland)

Can I file a claim in the UK or does this have to be in ROI? 

Can't seem to find any information on this and obviously I don't want to have to go to Ireland..

Any help would be muchly appreciated.

    Did you buy it direct from FitBit?

    If you did then your claim is where they are based.

    Might help if you explain exactly why you want to claim

    Will try to explain..

    Pre-covid I had planned to start a boot camp exercise enterprise.

    I had purchased 26 Fitbit Ionics watches all second hand. COVID and lockdowns kicked in which put the whole idea to bed.

    I left all the watches in a box in the loft.. 

    Two years later back end of 2022 I heard the Fitbit Ionics have been recalled due to a exploding battery issue.

    I have followed all the steps of the recall process, the watches have been internally shut down by Fitbit.

    During the process you have to agree to let them shut the watch down and they agree in return to pay you a replacement cost.

    They have shut all my watches down, I have all the reference numbers, they have ceased contact since January and no payment has been forthcoming.

    I have phoned/ emailed customer services, who then put you on to a different team to be told you will get a call within a week.

    Never happens..

    Kind of stuck what else I can do..

    This sounds more like a business enterprise than a consumer purchase. Can you clarify?

    You bought them all prior to Covid so about 4 years ago? All were secondhand so five or more years old now. Do you have any proofs of (original) purchase?

    Did you buy them all directly from Fitbit (eg. as refurbished), from another trader or individually from the original purchasers?

    These were all bought via eBay/Facebook second hand fully working, all tested.

    I obviously have proof of purchase from eBay/PayPal etc.

    I don't own a company, was looking to start a boot camp and thought I could possibly get and edge on other places by providing watches for participants to track there heart rates etc..

    My point being, surely on recall when I agreed to have the watches shutdown for a payment, that's the point where a contract has been formed?

    Nope... as my first question, seeing if I can claim from the UK rather than Ireland as they are Fitbit UK and Ireland.

    Where have you seen the governing law is in Ireland?

    ? I don't understand the question...

    Because the company is based in the Republic of Ireland, can I file a claim within the UK or does it have to be done in the Republic of Ireland as it's where the company is based.

    As FitBit are now a google co. Trace look to bear this out.

    No idea if this would work. As no idea exactly how this might tie in. Especially as you bought these 2nd hand & as per other thread. You are in some ways abusing the system. Which could well be a defence used by them.

  • I think you'll struggle.  Second hand business purchase four years ago and you expect warranty rights to apply?  You've clearly had no joy since April, what have you tried and why didn't it work?
